少，路段限制55跑到81。因为很少开车去NYC那边，所以路不熟，不知道那段限速只有
55。 加上因为飞机是11点的，当时8点左右离机场还有65mile，想尽量9点左右赶到机
场，还有想到进了NYC过桥什么的怕再堵车什么的就开了稍微快了点，因为天好，车少
，一般80左右貌似比较正常。结果早上8点左右在康州WESTPORT附近的时候被守在路边
测速的便衣抓到，上来也不给我解释的机会直接要我驾照，然后拿了驾照回车里，过了
一会儿过来直接把驾照和一张294的罚单扔给我扭头就走了。这是我来美国以后吃到的
第一张罚单，之前驾驶记录一直良好。
罚单后面有两个选项，一个是pay amount due, 另一个是plead not guilty。 我本来
想认倒霉交钱算了，后来这两天看了一下帖子，好像认罪交钱的话驾照要扣点（这边好
像是加点），保险要涨什么的，就打算plead not guilty,然后上庭赌一下。不知道这
里有没有人有过在康州上庭的经历可以分享一下的？
还有，刚看到，上庭的话貌似要先见attorney |

当时我正跟着前面的一辆卡车，前面的车突然开始减速，我以为他要拐弯了，所以就潇
洒的一个
Passing，结果刚刚超过去，就发现前方小路口里停车一辆警察，怪不得前车要减速呢
。我当时车
速大概45左右，路上限速35。 警车过了4-5秒钟就鸣笛追上我，让我停到路边了。
他走过了跟我说我在town里不能make passing，我心想还好不是说我超速，应该给个警
告就完
了吧，结果把我的驾照要走了，过了几分钟示意我下车，给了我一张ticket，
improper
passing intersection， 驾照也被扣下作为bond information。警察肯定看我是中国
人，驾照上地址又很远，不会去上庭的，所以才这么轻易的给我开罚单。
Anyway, 杯具了，第一张Ticket。没有了驾照，只好天天揣着护照了。
回来之后仔细研究了下traffic law，是说在intersection 100ft内不能超车的，但是

想超速,完全ignore今天是周日晚上,警察可能严打的可能性.而且看到路边有人被pull
over,我还在一边幸灾乐祸,殊不知警察要出动就是一群阿！
说正题,在I76 上Lancaster county 被逮,当时超车超忘形了,正好路有点downhill,而
且是有点小弯,直飚90mph,然后自己准备减速,正发现路边草地里一个黑黑的车顶灭着灯
的警车,心想死定了,继续减速,慢慢走,但是警车还是跟上来亮灯了.悲剧的给了我
traffic citation,89/65,176刀.到网上查了一下,超速16-25mph有4points.我11个月以
前有一个stop sign没停,已经有3个points了,本来马上要减3个points的，但是还差半
个月。所以如果plead guilty就第一次满6个points,要上written point examination.
plead not guilty，我离被逮的地方有100mile，不知道一般是不是在当地上庭。如果

我当时的确是开快了点，因为路上一辆车都没有。而且那条路弯弯曲曲，没去注意速度。
另外，在听到警察短促鸣笛到我在路口的stop sign停下大概只开了0.1mile。
人生第一张ticket，跟警察说能不能这次只给warning,警察说local没法给warning,而
且他都已经通知领导了
请有经验的朋友帮帮忙，看看我这种应该怎么做比较好。
出庭是肯定的。我应该选2还是选3？
罚款倒是不很重，$90，可要扣分涨保险就很不值当。

上庭如果判guilty的后果就是你给的罚款不会退给你。和认输一样。You have nothing
to lose.
当然是plead not guilty，跟着要求trial by written declaration。其实你plead的
那个是arraignment，和上庭两码事。
你在哪条公路给抓？I-5在central valley是限速70的。
罚款应该500左右，不是1000。 |

车的registration是11/30/2012到期。今天凌晨1：30am的时候已经在网上renew了

citation，不过看外州牌照也许就不给了。
这种情况，直接plead guilty，交钱，认罚，然后上学续保险，属于爷们；当然爷们以
后悠着点。
如果plead not guilty想出庭，那肯定请律师了，然后等着$500+的律师费，这属于有
钱人；你这个雷达测到103再加司机证词板上钉钉的事情，自己上诉几乎没有胜算，律
师可以给你搞到古怪的理由。
至于打电话咨询律师，又担心点数又担心保险，最后被忽悠得又交律师费又交罚款的，
属于骑墙派，这是美国司法专业人士眼中的肥肉。 |

你要先plead not guilty和交钱（亲自或通过邮件）跟着要求Trial by Written
Declration的表。到时候就把declaration寄回去就行了。
这个要看法官。但是不能因为你plead not guilty而不让你上驾校。 |

今天吃了一张speeding ticket. 罚 120， 扣4分。
我看到警察给我的单子上只有 3个选项：
1. plead not guilty
2. plead guilty or no contest
3. go to court
我如果想要他们给我不扣分或者少扣分，是应该选择1 还是 3 呢？ 我周围的朋友好
像都是去court 跟法官说。
选择1 不认罪的话，我看是可以安排一个 pretrial conference。 这个是不是用来
调解的呢？
但是为什么调解的时间要在规定上庭日期之后呢？ 有些不解。
