最近很多事情不顺利，早上开车上班为了赶一个会，竟然不小心在55的高速上开到了86
。我甚至没有看清楚警察是埋伏在路边还是在路上巡逻，直到警灯亮了才意识到。
警察在警车里面鼓捣了好长一阵子，过来告诉我打印机坏了，会把罚单寄给我……根据
滨州法律，超速31及以上算是最严重超速，必须上庭hearing，估计是交罚单，扣5分，
还有可能吊销驾照和上驾校。他亲口说30以内都是不需要吊销驾照的，我可以上庭给法
官申请，而且他会选择no objection.
我六年驾驶记录一直clean，这是第一次，不知道会有什么严重的后果，我该怎么处理
较好呢？现在还没收到罚单，焦虑中……
1.还有可能面临什么严重处罚？
2.还有argue的余地吗？他当时并没有给我看reading，我也不知道他怎么测出来的。
3.这个记录一定会涨保险吗？我觉得挺严重的，我怎么做才能降低影响呢？

果Trial by Written Declaration输了还可以重新上庭，跟一开始没有区别。
你选什么样的trial跟你怎么方式plead是两码事。无论你做Trial by Written
Declaration或直接上庭，你都可以亲自去法庭plead not guilty，或通过邮件plead
not guilty。
如果通过邮件plead not guilty，要提前起码5天寄出。 |

给的通知是10月27日前必须把单子寄回法庭。
违章代码1180D，扣4分的级别。
因为八月份刚从外州搬过来，不太清楚在纽约州speeding的严重性，所以一直没管。今
天去问了学校免费法律援助的律师，感觉比想象中严重得多。我超速的地点离家很远，
律师无法代我出庭。
1. 之前不知道纽约驾照有Probation，期间违章会被吊销。参加路考的新司机都会知道
，但我的驾照是从外州转到纽约的。不知道像我这种情况如果plead guilty会被吊销驾
照吗？ DMV网站上只写了路考得驾照的新司机的情况。
2.我问了律师，尽管已经过了48小时（plead not guilty需要在接到单子后的48小时内
寄出），但律师还是信心满满说这种事情见得多了，在27日前寄出去就行，plead not
guilty. 大家觉得我应该plead guilty吗？

前面有3个人
第一个。超市里偷东西，plead guilty,然后就是30天的jail，汗啊太狠了
第二个。协助其他人贩卖偷盗的ps3给gamestop，plead guilty,$1000刀罚款或者30天
jail，最后给了～$500刀罚款
第三个。是学校本科生。限速35开了44，plead guilty。法官毫不留情的给了$82刀的
罚款加上2个点。（你说，别人都特意为这个超速罚单来上庭了，好歹减免一下。结果
是一分不减。那两个点呢，这么好的态度，还是照扣）
第四个。就是我了。在一条没有什么traffic的小路上，慢慢悠悠的开着，放松放松，
在春假这个college town都变成ghost town的时候，被抓。我是100%停了，但是这个速
度是不是0，真还不记 |

ticket上有三个选择：
1. Plead not guilty
2. Plead guily. (Payment must be included)
3. Plead nolo contendere (no contest) (Payment must be included)
请问第二项和第三项在后果上有什么区别？
如果不想出庭，是否可以选择 no contest?
另外，如果选择 no contest并交罚款，还要被记点吗？

拍照到现在5周，我还未收到照片以及罚单，网上也查不到记录，也许是处理慢或者拍
照都在闪灯瞬间进行，由于我发愣过了n秒才右转没拍上？大家有在LA被拍照的罚单么
，通常都多久收到？
今天早上去上庭解决unsafe lane change的罚单，原定时间10：00，我大概9：20就到
了，进去一看，法官还没来。sign up之后找座位坐下，不一会法官来了，开始进行8：
30的那场（OMG，迟这么久）。这一场大部分都是拿到罚单按照第一次出庭due date来
的，好多人就plead guilty然后去交钱。有些人说自己没钱啊啥的延期，或者改成社区
服务。10：00的庭大概都是这种not guilty plea的，警察们在10：00陆陆续续都到了
，共来了至少15个！！法庭里面管事的人就开始点名，询问是否愿意plead guilty或者
proceed，有的人继续，有的人可能看到逮自己的警察来了就plead guilty了，交钱。
过一会我被点到名字，我原以为也是问我是要认罪还是继续，正准备回答，结果被告知

逮住了，说stiker过期，给了一张ticket，有三种选项：
A：plead guilty, pay $120. Conviction is reported to the Secretary of State.
B: Avoid a conviction on your driving record, plead guilty, register for
traffic school and receive court supervision, pay $165.
C: Plead not guilty and request 1)Bench trial before a judge 2) A jury
trial 3) A pre trial
第一次碰到这种情况，毫无头绪应该怎么办。我倾向于选B, 但不知道整个过程是什么
样的，那个traffic school 是怎么回事，会不会花很多时间。请大家给出出主意。

有转人工的都。所给的option里面也没看到有plead not guilty这个选项啊，只有
1. Appearance Date Extension
2. Traffic School Payment
3. Full Payment to Close Your Citation
4. Court Date Reservation for Arraignment Only
所以不知道如何plead not guilty。。。 |

发帖数: 167 | 45 这是纽约的情况，外地的未必适合，仅供参考。
1. 听一个律师讲，拿到罚单，先plead not guilty, 后面至少有10来天思考要不要改
为plead guilty。我老本以为这样可能会多交钱， 但是未必。好像纽约的就算你已开
始就plead guilty,那些狗屁的surcharge fee还是要交的。
2. Disobey traffic control Device 扣多少分还不一定，要看具体的情况。比如可以
扣3分，也可能扣2分。
3. Moving ticket 如果最上面的司机及车辆信息错一点，不会导致ticket dismissed,
错两三个细节，可能会； 但中间的细节比如哪天，几点抓住的，有一个细节错，就会
dismiss.
非moving ticket 可能司机及车辆信息错一点，就会被dismiss。
4. 听两个律师跟警察过招。律师就会问各种细节，探探可能的漏洞。感觉技术含量蛮
高的还。比如道路的情况几个lane，traffic control device 设置的细节； 是不是过
了桥第一个红灯，当时警察看的角度,推测会不会被挡住一些视线。车辆前后左右又没... 阅读全帖 |

人在PA。老公带着我和两个老妈去outlet血拼一天，回程已是晚上。在一个限速55的
local上开，一个下坡底部有个红绿灯。快到的时候（至少我觉得是）绿灯变黄，老公
觉得刹不住了直接冲了过去，可能在过线之前或者马上过线的时候红灯了。刚过就被
F150晃瞎趴住。
老公对警察说this is a judgement call，毕竟开车最忌讳的就是犹豫。警察倒是很
nice,不停地告诉老公relax，you're doing fine，说记录很好，第一次被趴，给你个
citation。就是批评教育的目的，看见黄灯的时候要有刹车的意识。说不影响我的记录
也不会上报pennDOT。不过得在十天之内Plead guilty or not。给了粉色的citation，
当时自己还说哦我这个单子拿错了，你就照着上面做就好了。我们以为没有记录，就没
当回事，结果回来仔细看了看，有一百多刀的罚款。。。查了一下发现citation还是有
记录的。
问题：
1.Plead guilty or not？我觉得他抓我们也是出于无聊，他也说就是正好看见了就抓
一下，this is his job。

发帖数: 12623 | 47 法庭没有必要寄东西给你。你签了ticket你就有责任处理到底。你可以打电话给法庭问
有没有你的ticket，要交多少钱。
你应该做Trial by Written Declaration。如果Trial by Written Declaration输了再
重新上庭。
这样的案件分成两部分：arraignment（就是你plead guilty或not guilty）和trial。
为了arraignment，你可以亲自去法庭，跟clerk说你要plead not guilty，交罚款，跟
着要求Trial by Written Declaration。你也可以通过邮件plead not guilty，交罚款
，和要求Trial by Written Declaration。
他们到时候寄Trial by Written Decaration表给你之后，你有大概三个星期写好
declaration，寄回去。 |

plead not guilty是否要求Trial by Written Declaration。这步可以亲自去法庭跟
clerk说或通过邮件做（deadline之前起码5天寄出）。
要求Trial by Written Declaration之后法庭就会给你表填。你有好像3个星期的时间
写你的declaration跟着寄回去。 |

变这个。
以前也有人问过关于这个一模一样的几句话。觉得有可能是想说If your appearance
is mandatory才you are not eligible for
a Trial by Declaration，但是打的语法不好，漏了“and”和多了个句号。（但是其
实这样也是错的。就算arraignment的appearance是mandatory，trial也可以是by
written declaration的。）
反正你不用管就是了。
arraignment就是plead guilty或not guilty的。可以亲自去arraignment或通过邮件
plead guilty或not guilty。跟着如果你plead not guilty就有trial。trial可以in
court或by written declaration。（跟着如果by written declaration输了还可以要
trial in court。） |

发帖数: 728 | 50 PA小镇，一大早上班高峰（near 8 am)。车转入到一个single lane之后，阳光角度很
低又是直射，我没戴墨镜，再加上车窗上的霜没完全除干净，导致我只能看见前方不到
一米。因为是single lane我也不方便pull over，只能很慢的速度随着车流慢慢开着。
限速35，我大约20-30。不知什么时候前面的车都停下来了，因为都要等着转入前方垂
直的大路。而我因为看不到的原因还在以原来的速度开着，直到撞到了前方停着的车，
被撞的车又连带撞了它前面停着的车。 我的车前盖开了，气囊都开了。车也报废了。
前面的车撞得倒不厉害，rear bumper稍微脱落了一点，再前面的车问题更不打。辆车
都能开。 警察给判了我负全责，这没问题，自认倒霉。跟他解释了是视线原因，他也
就是听着，不置可否。不过他承认我的速度应该没超，从车的损毁程度看“you are
not driving crazy”。 但要扣2分，ticket上写的是“Following too closely”。我
当时申辩说是自然因素的原因而且我已经因为看不见而低速了。他说如果看不见应该
