你扣分吧。

发帖数: 163 | 2 超速了，上来让大家给点意见。因为需要一些本地的信息，所以就发到GA版而不是车版。
今天早上开车在chamble tucker Road被警察逮到的，他测到我的车速是51,测的位置大
概和mercer university drive交界的地方，说路的限速是35。然后给了我一个单子要
上庭。以前没有遇到过这种事情，有以下问题：
1. 我看过本版以前的帖子，说可以认罪交钱就不用上法庭。5天后我会打电话去问要罚
多少钱，扣多少点。我的问题是是不是如果不扣点，就没有必要上法庭。因为上庭需要
上庭费，花的钱也不会少。
2。如果上庭的话，是不是有两个选项，plead guilty(认罪） or plead not guilty（
不认罪). 看贴子好像还有pretrial ,不知道和plead guilty有什么区别。我的问题是
我应该采取什么策略。我能说的就三点。第一 我是初犯。第二，chamble tucker Road
很多地方限速是45。警察截住我的那个点就有个牌子写限速45。第三，警察测的那个点
是下坡点。

发帖数: 51 | 3 你是在Atlanta上庭吧？除了认罪/不认罪/nolo contendere这三个选项之外，还有一个
选项是参加一个叫做pretrial intervention program的东西，不计分，无记录。需要
交participation fee。
相当于就是罚款了，不过据法庭的人说这个金额比plea guilty的罚款要低。
参加这个program的限制条件是：大于21岁，12个月内没参加过这个program，是比较轻
微的交通违章，超速应该适用吧

speeding在GA属于misdemeanor, 认罪了是不是就有犯罪记录了，n400的25项就只能填
是了？pretrial diversion program 自己跟法院申请？找法院本地的律师是不是好一
些，有可能跟法官或者逮捕我的交警认识。
申请公民的N400表格有问道逮捕记录，关押记录，犯罪记录。现在不知道该怎么办。
N400上的第23项逮捕记录是不是只能回答是，28项关押记录是不是也只能答是？最好的
努力结果是不是25项犯罪记录答不是，29项outcome答no charges were filed? 是不是
请个Enigma，GA一带的刑事犯罪或者交通罚单律师做 preteial diversion program,争
取吧两个罚单给dismiss 掉， no charges were filed? 或者把obstruction的罚单给
dismiss掉，弄charges filed，超速的罚单争取转为违规的罚单？罚钱，上课没关系的。 |

网站是NYS DMV那个，不是有打折的FINIANCE.GOV的。我输入了两张的信息都说找不到
，但是离15没有几天了，我比较着急。请问这种情况正常么？
然后我打算plead not guilty了。但是有两个问题，
1.NYC的traffic court据说很变态，不像一般地方，很多权利都没有。然后最重要的是
我想问清楚他们做plea bargain么？
2.如果我上庭的话，NYC有pretrial么？还是一上来就是正式的trial？

一个。前面去过两次，pretrial, 法官不承认，要了当时的录像，并没有speeding 的
纪录，对话感觉有篡改的痕迹。 罚款相差几十块呐。关键是自己认为也没有speeding.
冤枉不说，还被警察黑两次，不爽。还有一个wrong lane，右拐，前面停十几辆车，
都等着接孩子。从左边lane拐上，去右边的停车场，天天有人这样做，包括校车，有录
像为证，法官却不以为然。两个tickets 四百多。
法庭上该如何抗争？
有无律师接这个案子？

发帖数: 22303 | 14 刚才给NRA推荐的两个律师都打了电话，似乎都对外国人买枪的事情不熟悉。一个基本
没用，还有一个比较热心。他说让我马上给court pretrial service 打电话，找到给
zoun的case写报告的人。那个人是决定今天如何处理zoun的关键人物：立即释放，保释
还是其他，都由他说了算。律师让我打电话给他，跟他说说zoun的情况，但是不能谈这
个case.律师还说，法官会给我们指派一个律师。 他说先用那个律师，一般都是挺好的
律师，他自己也经常被法庭指派。如果我感觉不好，再去找他。我今天可以随时打电话
向他咨询。一会我再给大家推荐的那个本地律师打个电话，如果说法一致，我再联系
service的人。
大家说我需要给BATF打电话核实有关外国人能否买枪的事实么？怎么感觉打了几个电话

mistake before, had to pay the second fine and a reinstate fee for the
driver license at the end of the day. Maybe you can take some class so you
won't have your car insurance premium raised too much.

这个pretrial diversion program其实也是属于认罪的. 就是你先认罪, 然后做点事,
法庭高兴了, 就这案子就算撤了. 官面上没有犯罪记录. 但是对于移民而言, 其实还是
有罪. 这是一个好多人走进去的陷阱.
楼主好象是給charged felony count又是涉及violence.
这个在移民局眼里就属于crime of morale turpitude是算grounds of
inadmissibility.
我的建议还是找个好律师, 哪怕倾家荡产. 然后尽量拖着. 只要拖着, 你就是无罪.
态度要坚决. 检察官很难打赢这种官司. 特别是如果女方不合作. |

bad. It is easier to communicate with them and they are more likely to
understand your problems with immigration. So if you can find a good Chinese
lawyer, it should be fine as well.
It is too early to talk about evidence etc. When it comes to trial, your
lawyer will get the police to appear for a deposition in a private setting
and transcript will be available to you. Police may or may not show up for

很快要上庭，问了几个律师说法不一，有说9/10只是Arraignment B和警察都不会出庭
，且B收到传票是10月份：

If it is for arraignment they will not be there and I think it is for
arraignment. There is no such thing as a "pretrial".
律师2:
9/10出庭的有证人，检察官，警察，被诉人，法官，律师。可以打掉重罪，建议接受轻
罪，1年内不犯自动免除。也可以尝试不认任何罪，不行再退而求其次认轻罪。
律师3:
