过了140，好像485不怎么查了，我也不确定。
反正，要查起来，从PD那年开始，只看以前每年W-2上的工资，你加班工资多了，也许
就高于proffered wage,如果低于，那么差别的部分要比公司的net profit低。这都是

联的。埃里克·玻尔曼案是美国高等教育学术不端史上最具影响力的一个案例。在此案
调查的过程中，各个相关部门严格遵照美国联邦政府颁布的关于学术不端处置的文件，
有条不紊地向前推进；针对玻尔曼的处罚，涉及到民事赔偿、行政处罚以及刑事责任。
本案的特殊之处是：行为人是美国历史上第一个因学术不端而被判重罪入狱之人。
此案带来的启示是：在预防和处理学术不端的过程中，高校与政府机构等部门需密切合
作、完善法律法规、坚持程序正当原则、发挥“吹哨人”的关键作用，并辅以严厉的处

证明"ability to pay the proffered wage", 所以你如果不在这个公司了，那么公司
的NET ANNUAL INCOME/ASSET 要多于你的proffered wage in PERM. 有些公司（ICC）
同时帮多个人申请140,USCIS会要求那个net income要大于所有人的proffered wage 或
者difference.
所以说如果雇主不同意（通常都不会同意），也没什么可留恋的了。
不过这也不是绝对的，如果雇主以前都很顺利的搞定其他人的I-140,就不存在上面我说

另外，是应该看W2 上哪个数据呢？Gross Pay or Repored W2 wage? 我的gross pay
是一直够proffered wage 的，但如果去掉Tansit benefit， 401K等等的Pre-tax

没有申请下来（一言难尽跟政府部门打交道的难处啊。。。）在递交H1B申请的时候把X
州的执照复印件附上了。
问题就出在工作所在州的执照上，H1B RFE中要求提供工作所在州的执照。原话是这样
的：
Licensure: The proffered position appears to be based on an occupation that
may require a license for an individual to fully perform the duties of the
occupation. Submit the license or evidence from the appropriate licensing
authority that the beneficiary may perform the duties of the position with
no license.....

发帖数: 174 | 49 天真的我以为抽中了名额就不用担心什么了。跟现在agent的合作除了H1B的申请以外都
是很顺畅的：没有工资拖欠，按时email附上payroll文件，但是关于H1B的事情一直不
顺畅，昨天收到自己fail的消息后就尽可能的收集了很多信息，现在整理如下，希望大
家帮忙分析下。
agent的情况
1. 公司地址在google maps上查了下，一个是居民区门前的荒地，一个是居民住宅区，
都不是商业用地 （不靠谱）
2. 用agent名字去linkedin上搜索了下，跟agent有业务的公司非常有限，就几个公司
，像我这样的合同工多半都在那几个公司。
3. 去myvisajobs查了下，这个agent基本上没有给别人办理H1b的经验，这也解释了为
什么llinkedin上查到的他们经手的合同工基本上都是老美的原因
4. 查到了agent的老板在linkedin上的名字和跟我联系时的名字不是一个名字，但是是
同一个姓（可怕啊），然后他说他经常要出差，我很怀疑他是在回避跟我见面，但是在
linkedin上查到他现在本职工作是一家公司的technical sales， 这是不是一个需要经
