法盲。在美加刑事法上，在犯重罪过程中造成他人死亡，要罪加一等，应以谋杀罪起诉

绑架罪行。
然后还有每一个罪行的道德可指责性-Moral culpability。如果你杀人是自卫，可以无
罪，如果是对方有错在先或provoked，也会据此在量刑时减轻处罚。比如西方常有一个
父亲常年性侵女儿，最后被女儿谋杀死，这个女儿只会被轻判。然后就是那些因为某种
私人感情矛盾杀人的，都是被认为可以在某种程度上得到谅解的，其中最多的是情杀，
朱海洋次永非就是情杀，因为被同样是华人的女朋友拒绝而情杀。还有就是一般家庭内
部的杀人往往被归类为domanstic violence，由双方矛盾造成，量刑时会减轻处罚。
而张莹莹案的Moral culpability 却属于最高一类。因为藤森谋杀的是于自己毫无瓜葛
无冤无仇的弱小女性，而且是弱者中的弱者少数族裔女性，用的是极为卑鄙的欺骗手法
，杀害的手段惨无人道，是美国当代史上最耸人听闻的血腥谋杀案之一。

遇到这本中学生读物前已经好久没有投缘的书进账了。Gandhi：Fighter without a
Sword是儿子从学校的免费书堆里淘回来的，书页枯黄如古籍状。书于1950年出版–那
时甘地被刺刚刚两年–次年获得美国少年图书最高奖的「银牌」Newbury Honor。作者
是美国颇有名气的儿童读物作家Jeanette Eaton。看来这书在美国读者不少–儿子拿到
的这本是1970年第十四次印刷。儿子读了书，写进读书日志里。老师在日志的Gandhi一
词旁边批：「One of my favorites!」
几年前看过得奥斯卡奖的电影《甘地》。那时很受震撼，连看两遍。后来跟一个从印度
