dual status的部分写了这么一段：
You cannot take the earned income credit, the recovery rebate credit, the
credit for the elderly or disabled, or an education credit unless you elect
to be taxed as a resident alien(See Election To Be Taxed as a Resident Alien
on page 2)in lieu of these dual-status taxpayer rules.
Election To Be Taxed as a Resident Alien on page 2指的是first year choice.

home buyer tax credit and the recovery rebate? My wife was not eligible to
apply SSN. I forgot to apply EAD for her last year (2008). We did not get
any stimulus payment because we filed jointly. I heard that this year (2009
) we still can ask for that. However, I just e-filed her EAD application to
TSC. It does require finger print. So, I doubt that I can get any info
before April 15.

to file your tax return if you cannot get ssn for your wife before April 15.
I bet you can get the EAD and then SSN for your wife before Aug 15 (that's
5 months from now), then file jointly to get the recovery rebate. If you owe
any taxes, you still need to pay IRS before April 15 even you filed for an
extension.
For the $8000 tax credit, I am not sure. But my guess is as long as you guys
can file jointly as resident, yo |

发帖数: 10390 | 27 我觉得理论上你应该把1042S加上W2放到7行,然后21行用treaty去掉1042S的数目.
这个你可以参考1040的第7行关于fellowship的说明.有些特殊的填写方式.
这样计算earned income的时候,你的第7行可能超上限了,但是instruction的48页在算
earned income的时候让去掉"taxable fellowship".我觉得你们的fellowship是
taxable的因为不是付的学费,但是因为treaty才没缴税,所以,最后这么思路下你们还是
可以拿到eic.
1.没用过turbotax,不知道在填第7行的收有没有分类让你填?
2.这个不缴税拿EIC的挺正常,尤其对一些养孩子又比较穷的家庭,算是一种救济.
3.recovery rebate跟你的child credit多少有关,这个可以通过irs的recover rebate
credit calculator来研究.我也没拿到整数.
4.上面说过了.不过想想你们家收入不是那么差,拿这么多EIC有点过,不过话说回来,谁
叫你们拿的是被特殊的中国treaty免税掉的fellowship呢. |
