已经拿到offer了,正在进行背景调查(背调公司叫backcheck)
我的第一份工作只干了6个月,后来被terminated due to poor performance.(小公司
被收购,新老板来第一件事就是开人。。。)
给我的termination letter上只写了terminated due to poor performance,但是
Record of employment上面的原因是dismissal。
现在背调公司让我写的这一段经历,我也如实写了,原因写的是termination
我之后还换过两个工作,都不错,没有不好的记录。
问题是:如果打电话给第一个小公司,HR说我不能rehire,会不会影响我这份offer啊?

我期中一个公司的hr是我的哥们,他打电话告诉我了,说调查公司问他“If there is
another opening in your inc., *** will be reconsidered? ”
这不就是明摆着问吗? 我的哥们自然是没话说。
但是我担心那个没表现好的公司的hr,要是说|NO|,会不会影响我的offer啊。。。。

我在过期的前一天收到新卡(算来是第79天approve,第88天收到卡)。我send到
Phoenix lockbox,还以为nebrasca会快一点,原来一样。
我跟LZ经历差不多,打了至少3次电话,每次答复都不一样。local office帮打电话,
也因为不到75天被拒。被告知不在发interim card。
而且我们HR 要求必须看到卡。 收据,还有USCIS website的approved notice 都不行
。我们的规定是,在过期一个月以内收到新卡,benefit会保留,rehire也很容易,超
过一个月就不行了。

我的OPT,7月29号(今天)过期,学校律师给申的H1B签证的start date却是8月15号(
前两天刚收到),还叫我到原毕业学校extend I-20,但是原毕业学校说我不适用于OPT-
H1B cap gap automatic extension! 今天系里说只能先terminate我,再8月15号
rehire。但是这个过程也是很麻烦,还要provost批准。请问怎么办??
还有,我的labor certificate学校也在上个月file了,如果我有两个星期没有被学校
雇佣,会有什么影响吗??
真是倒霉呀!

谢谢!我的H1B没有要求我出境,我之前也没有用过2个月的Grace Period.
在7/30到8/15这段期间只是off payroll就行了吗?还是得像系里说的那样,先
terminate我,再rehire.

EB1A based is fine in this case (还有用). But then even if you are not
doing the job, you can use a future job offer to pass this RFE. EB1A does
not even require same/similar job because it is self-sponsored. You were
too remissed to screw up this simple RFE.
But if your I-140 is PERM based 已经批准的140 almost 没有用. You need to
original I-140 sponsor's support to file another I-485. Because AC21
portability starts after I-485 pending for 180 days, it does not allow you

春节想回家2-3周,老板没意见 不过他问学校我度假的问题 可是学校说我没有假期
不能休假,说要是回国的话可以terminate我 然后rehire我
faint,就是因为明年3月前都不用签证才想回国跟对象团聚的 要不也不会回了直接等
卡再说了
他们说的terminate后我岂不是就回不来了? 真不知道学校咋搞的?
要是terminate了 我140会受影响不? (1个半月了)

我当时是一样的情况,最后没有签CPT,离职等EAD(其实就差了七天但是national lab
rehire很麻烦于是就放弃了)。当时CPT都拿到手了,看到签名的地方说I certify
that I seek to enter or remain in the United States temporarily啥的就没有签
退给international student office了。

EAD 已经申请还未接到任何的通知。 公司已做好要 rehire 我的准备。心里急啊。
今天 网上一查,老公和我 的 状态 已是 card in production

就告诉你, infopass没用, 我刚去做过,没到90天, 人家根本不理你. 我的H1上周五就
到期了, 7月中申请的EAD还没下来, 害得我被terminated了, 尽管公司说等我拿到了
EAD再rehire我, 郁闷S了. 还好今天查case, 刚批, 估计下周能收到.

depending on what I-140 will be the basis of your I-485.
If old company will sponsor you and write a letter promising rehire you
after GC, then you can file I-485 now(PD current) with old company's
employment/offer letter.
If you are only using old company I-140 PD but will be based on the
employment of new company, you need to wait for the new I-140 to be approved
and then file I-485 asking to port earlier PD.

If he cannot get any kind of EAD or O1,... there is a possibility he has to
stop working for a few months. Now it really depends on the employer,
whether they will let him wait(either in another status such as F1/F2/H4 or
out-of-US) while continuing to support the PERM/I-140 and rehire him and
file I-129 when I-140 is approved.

今年3月中旬降级交了485,11年3月底的PD,现在140,EAD都批了,在等排期回到11年
。昨天老板同意给我升职,但是好事多磨,因为我们部门小,做我这个工作的没有更高
的title,所以他们现在在和HR联系,准备写job description,创造一个新职位,然后
让我上网申请,说是要rehire我。我估计JD不会有太大变化,但是有些担心这样的程序
走下来会不会影响我将来批485,毕竟不是已有的职位直接改payroll的问题,请有经验
的xdjm指教。
另外485pending180天后可以换工作,是指RD后180天吗?还是说180天内换了工作,但
是移民局180天后才看到你的case,那样也不影响呢?

飞快看了一下合同,好像是属于Employment At-Will那种。这么说来就是签了也可以不
去,或是即使去了,也可以马上走人?没办法,谁叫这里的雇主裁起员来也是毫无人情
可言呢。

在parent mailinglist 上已经吵翻天了。大概是教师(或者教师工会)和管理层长期不
合,最近几年已经连续换了5个校长。这次先是突然6/11通知换校长,新来的是原来
Eaton 小学的校长,并且所有employee要重新申请上岗(不是解雇而是学区内换校)。然
后6/15学区和家长开会解释情况,基本上是什么都没说,只是说学校里有tension,具体
问题因为legal原因不能说。这时候情况看起来还是可控的,据说大部分教师都申请了
留在这个学校。到了6/18,突然又有通知说所有的教师都要换走,没有说为什么。家长
们顿时就炸窝了。毕竟对在这个学校已经上了几年的小学生来说,突然面对一群全新的

此次被裁的时候说的非常清楚,被裁的人不能做internal transfer,只能从外被申请
,被当成external candidate
我想这也好,也许可以重新negotiate level和salary
从外部申请了之后, 今天HR打电话来安排面试,期间提到如果我通过面试的话,他们会
给一个lateral offer,意思是和以前的level/pay是一样的,如果要改变的话需要很大
的exception,基本上不会改变,就算我找到了其他公司的工作有更高的工资,微软也
基本是坚持以前的工资,当然我可以选择去或是留
大家看看,这个是不是有点矛盾?微软这样做有没有Discriminate former Microsoft
employee?

现在不是negotiate level的时候。
听说就是外边的公司,现在也不容易negotiate,就是因为这些layoff把当地市场变成
买方市场了。这事实际上在软裁人之前就开始了,因为都听说了软裁人的风声了。

怎么做? 你如果觉得其他公司整体的offer更好,那当然是去那个公司,就算你没被
layoff也应该去啊。
