在填 I-131 和 I-765 表格的时候，老师谈过些许 AP 和 EAD. 可能是说得不够细，今
天再啰琐几句。
随着 I-485 的提交，申请人可以开始申请 AP 和 EAD. 大概 USCIS 的本意，是 I-485
的处理也就是几个月的功夫。所以，AP 和 EAD 的有效期都是一年。可由于有 Name
Check 的介入，现在 I-485 的等待数以年计。好在只要 I-485 在 pending 之中，AP
和 EAD 就可以 renew，年复一年。

考古了一下，AP入境后就是Parole/COS身份了，如果不reinstate H1b的话，万一485被
拒，就立即失去身份。所以还是想再申请一下reinstate保住H1b的身份。
请问有没有人有相关经验，能不能自己办？
我不想involve公司，否则HR知道我可以用EAD工作，可能不乐意支持H1b的申请。
请大家提供点信息，谢谢。 |

发帖数: 2549 | 3 讨论过很多次了，Using AP will invalid your H1B, H1B身份会失效,没有了双重身份.
好处是，可以比较方便reinstate H1B(递交H1B延期申请，或Transfer H1B申请),重新
获得双重身份.
但用了AP，如果你不reinstate H1B，就不会重新回到H1B. |

我当时是转成MA的licence/registration,觉得就自动地和原来州没关系了，可事实不是这样的，你得return license plates, 不然的话，他们认为你没有交registration fee, 一段时间后，就suspend 你的licnese/registration.
MA呢，是要看其他jurisdiction的记录的，当他们看到你在其他州有suspension, 他们自动suspend你MA license，要求你把那个suspension有所了断，不然不能 reinstate 你的MA license.
我当时就很莫名其妙得收到MA RMV的信，说你的license被suspended了，你要自己处理好原来州的suspension, 然后罚款$100才能reinstate MA license.
当然后来是一分钱也没花就搞定了，但这个事情证明，NY要弄你，MA也跟着弄你。 |

在日本转机的。俺打过去电话问，说直飞航班被取消了， 只能转机。 他们（包括
SUPERVISOR）也不知道原因， 也不知道直飞的航班以后会不会REINSTATE。 不过告
诉我以后如果REINSTATE直飞航班的话， 可以给改回去。
因为是给爸爸妈妈的机票， 所以让他们在日本转机不太放心， 而且肯定辛苦（路上
时间要多7个小时， 而且可能到了北京就是深夜，不能直接回家， 要找旅馆住一晚）
有什么办法能投诉或者挽回点损失吗？ |

发帖数: 9352 | 22 这有本质的不同，H1B两个工作之间有的是个GAP，你得到新的i797的时候，移民局已经
批准了这个TRANSFER, 在拿到新的I797之后，就不再存在GAP，更有没有什么OUT OF ST
ATUS一说，身份从此就已经从灰色地带到完全合法了。
但新的I20不需要移民局批准，只有被USCIS或CBP REINSTATE之后的120才是重新具有合
法身份的。在USCIS，这种情形几乎都是零容忍，很难会被REINSTATE，搞不好还会被列
入遣返名单，所以才有到边界CBP碰运气一说。

晴天霹雳，今天一早突然被通知身份即将或已经失效。
事情是这样的：
在opt extention期间，公司倒闭，在学校的IT部门找了份GA的工作（由于是暑假，用
的是opt的ead卡），这份工作当时也上报给了学校的国际学生办公室。与此同时，也申
请了计算机系的秋季硕士。差不多要开学了，研究生院把IT部门给的offer letter送到
学校的国际学生办公室去处理I20。结果国际学生办公室发现学校不是e-verified的，
也就是说我暑假在IT部分工作是不合法的。他们给了我两个选择：
1，马上申请reinstatement，期间可以自己交学费，上课，等USCIS结果
2，回国重新签证，他们答应可以等我签证之后再terminate前一个servis号
哪个选择好？1的话不知道reinstatement需要等多久，是否通过也还不一定，... 阅读全帖 |

1。我的陈述理由就是忘了转I-20误以为系里会转，这样这样通过的可能性大小
2。移民局审理期间的几个月我不能校内打工，那好几个月的funding也没有了。 我可

发帖数: 110 | 30 刚刚发现I-20 过期一周了。。。F1 学生 应该怎么办？
国际学生办事处 给出了两种选择：
1. 他们给issue一份新的I-20，sevis document。然后travel回国，重新签visa来美国。
这样等于重新建立一份新的移民档案。
这种做法的concern是visa会不会过不了？
2. 向USCIS提交一份reinstatement的申请，解释为什么falling out of status,然后
提供材料若干。这种做法的缺点是take的时间很长3-6个月吧，而且在申请期间还是out
of status的状态,很多事情不可以做，例如不能开车，不能on campus employed。。
。但是可以register学校的课。
而且 这份申请最后也有可能会被deny。
不过国际学生办的老师说 一旦reinstatement的申请通过了，个人F1的record不会有
gap。
哎，无论哪种方法费时费力费钱 且不说了，不知道有没有知道这个问题的牛人们指点
一下，哪种选择更靠谱啊？

昨天去close房子
结果到最后一刻 银行居然打电话来说 我们的Home insurance被geico cancel掉了
我们马上打电话到geico问怎么回事 怎么不通知我们就cancel
geico居然说，通知你们了呀，信件寄到你们家地址了，which is the house we are
buying!!! 我们还没close怎么收得到信件？！！！
然后让他们reinstate 说没有办法reinstate了！尼玛我们付了一年的保险费好伐，
cancel掉也没有退款啊！！！
然后说要重新申请一个保险，尼玛一堆房子的细节问题啊，这会儿已经三点多了，我和
ld在银行里跟他们打电话，银行四点关门！关门了就办不了bank check 没法close了！
seller第二天就回中国了，要是当天close不了不知道还要等多少天！这个房子我们12
月签的contract! 已经等了五个多月了！
后面还有很多drama!!先赶火车去了 回头再来八
反正我和ld决定这辈子再也不用Geico了！！！ |

我之前持有F-1，5月7日过期。 4月16日我申请了H-4，一直处于pending阶段。8月5日
，我收到了USCIS的notice要我补充材料。8月8日，我寄出了补充材料。8月底和9月15
日check，都是要补充材料。9月16日，我打电话去询问，说是没办法知道USCIS是否收
到补充材料，让我等60天。因为怕USCIS没收到，所以我今天又寄出了一份，不过已经
过了9月4日的due date了。如果USCIS因为没有收到补充材料而拒了我的H-4，我是否有
机会上述？
我先生的工作是8月29日丢的，虽然他的头说他的vacation pay不算employed状态，但
是human resource好像没有这样做。至少，他的pay check还是很正常的半个月一付，
而没有一次结清，所以可能到10月20日还是算employed的状态。这样的情况下，USCIS

找了移民、民事律师做过全面的咨询， 希望下面信息能帮到你。。。
因为前面建议都很好，不过，大部分人忽略了一点：首先你要赶快问一下原来学校iso, 有没有上报移民局（估计已经报了）， 自从有了sevice系统之后，移民身份变得严格许多，不能像以前很多人那样随便到语言学校之类的转身分就万事大吉了---- 你即使拿到了新i-20转校到新学校，在身份上 还是黑的，还需要重新向移民局做一个reinstatement， 解释你为什么原来黑掉了， 有什么理由还要恢复你的学生身份（前面有位大虾提到），如果这关不过， 还是要回国重新申请visa过来。

是不是说如果学校报了sevis那我的身份就黑了, 再有I-20,不论什么学校,都要解释
reinstatement?
而如果学校还没报, 如果学校留点情面, 暂时等我拿到其他学校的录取,再transfer,
情况回不一样,就不需要向移民局结实什么了?
就象前面帖子的说法一样, 直接relase record新的学校直接接受打印I-20就行了?
这里面的过程到底是怎么样的?是不是有不同?
还是恐怕只有再找到master的学位迅速录取,才是唯一的路?
iso, 有没有上报移民局（估计已经报了）， 自从有了sevice系统之后，移民身份变得
严格许多，不能像以前很多人那样随便到语言学校之类的转身分就万事大吉了---- 你
即使拿到了新i-20转校到新学校，在身份上 还是黑的，还需要重新向移民局做一个
reinstatement， 解释你为什么原来黑掉了， 有什么理由还要恢复你的学生身份（前

给你宽限， 只要f1身份没有被黑掉你完全可以去语言学校--不需要做那个什么
reinstatement， 因为只是学籍变更罢了。。我朋友当时收到dismiss信的时候看到那
个信cc给了iso， 最快速度去iso求情都已经来不及， 老美做事情很死板的， 就算知
道把你推火坑也不care。 幸好他学业职业背景很好，被dismiss的原因也很牵强，加上一点运气所以找到了新大学，现在就在新学校研究生项目里作reinstatement中。 不过也还是命捏在移民局手里..
.associate学位不知道算什么，不是前两天哪个版有人也遇到类似的事情， then他从
研究生转到associate结果遇到麻烦了么? 还是问你们iso的负责人。如果被黑掉了，就
按照我上面说得找有degree学校
就像很多人h1一夜之间被laid off没有grae period ， 后来找到其他方式过渡还可

when he left to Japan.
Really? Never heard of it.
Never heard of this.
