查标准），不是一个级别。种族歧视为最高保护等级，政府很难取胜。但是基于种族的
不同待遇有2个缺口：历史平权（remedy past discrimination)和Diversity in
Public Eduation。当然以上2个缺口也有很多详细适用规则和标准。没看最高院的关于
AA的详细判决，不只是基于什么。不管是什么，开了这个先河，就会演绎出许多可能。
个人认为，Over-protect一个群体就会或者容易对另一个群体造成歧视和不公、利益损
害。一些貌似公平的规则如果Abusive适用，就会是另一个极端。就像“政治正确”，
运用过量就是“凌驾”于法律之上。所以需要监督机制，人类都有局限性，千万不要挑
战它，认为谁会是完人。 |
