偏读了法官的判词：“That said Wong Kim Ark has not, either by himself or his
parents acting for him, ever renounced his allegiance to the United States,
and that he has never done or committed any act or thing to exclude him
therefrom”。法官明确的指出了黄金德从来没有放弃对美国的忠诚，从来没有放弃过
美国的公民权。
黄金德的案子在当时就是海关人员根据排华法案歧视华人而已，法官把排华法案的因素
踢出去，黄自然就赢了，毕竟当时别的国家来的都是在美国出生就有公民权，根本不提
管辖权的事儿。至于管辖权，在这个案子里谈的很浅，根本没有深入，有互相抵触的案
例在前，没必要在这个问题上争论。 |
