签的。
印地版本的区别在于明文把RFRA的适用范围推广到了营利性机构。这是对最近最高法院
对Hobby Lobby案裁决的确认（reaffirm)。高原的裁决认为联邦RFRA的文字虽然不明确
，但是适用于小团体拥有的盈利性组织。有十几个州先后通过了类似法案对此给予明文
确认。
但是，印地州长已经解释过，商家必须举证说明自己有宗教信仰，并且他们的宗教信仰
不认同同性恋行为。
这直接排除了任何上市公司，因为上市公司不可能证明所有持股人有共同的宗教信仰。
对非上市公司，拥有者必须证明他们有宗教信仰。光嘴上说的不算。象我这种不去教堂
，看到教徒发传单就绕着走的不算。
证明有宗教信仰之后，还必须证明这个宗教强烈不认同同性恋。犹太教，天主教，基督
教，伊斯兰教都有相关的经文和很长的历史。阿猫阿狗自创一个教不算。

节规定为，如果宗教组织的保险不能提供避孕，写个条子给卫生部，卫生部会来提供这
个服务。
宗教组织怎么反对呢？他们没有选择第一修正案，高院早就说了，如果制定的法律是宗
教中立，那么也就不要求对某些宗教有特殊照顾，第一修正案的宗教自由不保护这个。
宗教组织就选择了宗教自由恢复法案，(RFRA），理由是，政府不能给宗教的运作施加
很大的负担，必须提供最不限制的方式（government may not substantially burden
the exercise of religious beliefs and must regulate using the least
restrictive means.）你让我写条子给卫生部，负担太大，忘了写，还有一笔巨额罚款
。太歧视我们这些宗教人士了。
因为去世的大法官Scalia, 高院的处理有点不同寻常,高院在要求双方协商出一个都可
以接受的方案。
一句话总结，这个案子已经是Obama医保计划的细枝末节了。

享受联邦RFRA的保护。
说到O8care的exempt，具体是这样：
1. 如果是place of worship，直接豁免。
2. 非盈利宗教组织，需要告知他们用的保险公司。然后保险公司照样保避孕，只是不
向雇主收那部分的钱，而是从政府拿纳税人的钱。
就这个第二点，little sisters of the poor，Norte Dame 都还在上诉，认为还是
burden了他们的religious freedom。 |
