. The rulemaking process can take 90 days or more from the date a rule is
prepared for publication, however, so DHS will have to issue a new rule very
quickly to avoid the consequences of this decision.

所以我觉得，只要能够精炼到以下2点，哪怕任何一点成功了就是胜利。
（1） I-140 portable （不用再说PERM portable了，为什么呢？ PERM和I-140是在一
起的，办了PERM的人肯定会办 I-140, 一件事何必分成两见事说呢？）

是基于个人对于美国行政程序法的了解而提供一些背景知识。
1。美国行政程序法(Administrative Procedure Act)规定政府部门有不通过议会而直接
制定或者修改有关法律实施细则或者规则的权力，在很多情况下，这些规则专注于程序
性与细节性的事务，根本不可能拿到参众两院来讨论，所以，很多情况下只是几个处级
干部或者办事员就整出了一个规则的初稿，这是和中国很相似的。这次搞出来的很多东
西，没准有拍脑袋的成份在里面。被大家骂是可以理解的。
2。美国行政程序法(Administrative Procedure Act)同时也规定政府部门的规章制定与
修改必须接受公众评议(notice-and-comment rulemaking)，一般都有几个星期甚至几个
月，在评议期间规则通常不可能立即生效。所以，我个人的理解，这次的interim rule
还不是最后生效的规则，还有机会被修改。这里，就需要所有被影响的同学们出力了。

我现在在一家non profit公司工作了2年多，目前的I797在2013年底到期。目前找到了
一家profit公司的工作，新公司已经在6月重新申请了h1b，目前已经收到了receipt。
但是公司希望我7月去上班，然后再h1b被批准之后停止上班，然后在10月1日再上班。
公司明白这个gap而且能够接受。但是我有些疑问：
1. 这样的办法是否真的可行。公司的律师是说没有问题。我考虑是依据那个移民局的
信。
2. 如果h1b在10月1日之前被批准了（很有可能在8月或者9月被批准），我就需要停止
工作。公司律师说不需要离开美国，但是不离开美国我不就是out of status了么？看
到Murthy上的说法是需要离开美国。这个不知道有没有人有同样的经验。

already available and doable way is to allow the petitioner to FILE
