发帖数: 43471 | 2 前有看门兄后有北大飞。这个shall vs may已经是千年悬案了，在当代立法里shall几
乎从来不能用在grant前面。这里面有两层原因，第一shall是非常容易被滥用和误解。
因为从文法来说shall在不同语境下可以等于may,will或者must。甚至很多法律界知名
人士已经强烈要求禁用shall。法学院教的时候也是教不清，或者教的人自己也不明白
，就会告诉学生shall就是must。其二如果认定shall等于must，也就是说shall grant
= must grant, 这种字眼根本不会出现在立法里，而是应该出现在判决里。grant通常
是给与某一方某一种的privilege，很难想象有任何法律会要求某一种privilege应该是
无条件可以获取的，除非加上几十页限制条件，从立法角度看这简直是开了无穷无尽的
loophole.所以may grant几乎是定例，这样可以给执法部门一定限度的自由裁量权。

问题一直遮遮掩掩的呢。这次坚决不做顺民了，学校让带iPAD坚决不干，合法合理啊。
违反的是加州教育法第49011条的(b1)，(b2)和(b3)。
