从不受配额限制(cap-exempt)的机构转到受配额限制(cap-subject)的机构工作的H1B受益人, 在转换雇主的申请递交到移民局之后，年度H-1B生效之前(10月1日), 是否可以立即开始工作？这是一个大家普遍关注，但是一直没有明确答案的问题。
最为典型的例子：A目前持有大学的H-1B。 有效期至2008年4月。受名额限制的新雇主于2007年4月2日为A递交了H1B申请，要求H1B开始的时间为2007年10月1日。新的雇主希望A立即开始工作。在递交的LCA中所列的H1B起止时间为2007年4月10日至2010年4月10日。在这种情况下，A是否可以在接到H1B的收据之日起开始为新雇主工作？
这里涉及到“工作许可”和“H1B身份”两个基本点不同的概念。

我现在学校做postdoc，持有cap-exempt的H1B，有效至今年8月31日。半个月前拿到一个
公司的offer，公司希望我9月1日就开始上班。我第一次申请cap-subject的H1B，
公司律师说2007年有一个什么memo，即使有cap，10月1日之前也能合法工作。
因为我现在的H1B 8月31日到期，律师递交了两份申请：
一份是H1B extension, 将我现在的H1B延长到9月30日；
一份是H1B transfer, 将我的H1B的sponsor转到新的公司，9月1日开始。

是系统错误。回去看了
下ds2019表，查了下，竟然发现subject fields 不在skill lists中。作为中国出生的
也算是很rare的情况了。可见当初申请advisory opinion ，DOS也不认真给审核，毕竟
没交钱，只要看到中国人就给结果是subject ，而且当时给我的decision 还是因为
field 在skill list上所以需要豁免。然而真正申请waiver 阶段，他们才会真正审核
每个人，发现not subject ，就顺便把之前的错误改了。由此可见，advisory opinion
基本无用，因为他们根本不正经的审核……不过我的case处理挺快，前
后不到一个月，不知道是不是这个advisory opinion 起作用，还是我每周发传真起作
用……
结论就是，如果你的subject fields 不在skill list上，又没拿两国政府的钱，

31, Subtitle B, Chapter V, Part 515 , Subpart C , Section 515.329。link在下
面。
相关的是 515.329.b, Any person within the United States, 其定义在
515.330, 515.330.a.2 包括了 Any person actually within the United States。所
以当前的定义是包括非法移民的。这两条code都没有明确排出外交使节。因该是另有规
定。这个定义，多大程度上是14修划定的，并不明确。
515.329.a我的理解是公民，绿卡和公民不管人身在不在美国，都算subject to the
jurisdiction of the United States。
要排除任何非绿卡／非公民，需要修改515.330.a.2; 要排除绿卡，还需要修改515.329
.a。任何修改都有违宪的争议，会被告到法院。

在用SAS做ANOVA analysis的时候(我用的是proc glm), 怎么样specify哪些variable是
within-subject effect, 哪些variable是between-subject effect? 我知道所有
repeated measures variables都是within-subject effect, 可是我的data不属于这种
情况啊, 而且如果有多于两个viariables属于within-subject effects, 这个repeated
option很不好用啊, 没办法specify两个或者两个以上的repeated measures
variables.

If each subject were measured only once I could have done a ROC curve to see
if X has any prediction value for Y, but since now each subject is having
multiple measurements (from different time point), is it possible to do a
ROC analysis?

If your research involves only the use of non-identifiable biological
specimens (e.g. teeth, saliva without any identifiers), it may not meet the
definition of "human subject". But you'd contact your IRB office to confirm
whether a formal determination is required by your institution.

前段时间一直在关心学校的H1b能不能transfer到工业界，答案是不行，这样对很多人
来说，就会出现gap
结果进一步研究，发现cap exempt的H1b只要没有过期，是可以"port"到cap subject的
职位，用来渡过可能出现的gap的。
这对想从学术界转到工业界的同学们是一个非常好的消息，当你在四月份申请新的cap
subject H1b时，如果你的cap exempt的有效期能到10月1号，你就没有gap的问题。
当然现在还有很多律师不太清楚这一点，因为这个曾经有争议，我手头有uscis的一封信可以做为证据。 |

government是属于USCIS定义的cap exempt organization，具体细节如下sec. 214.2(h
)(19)(iii) 本人现用OPT 但是律师说不能申cap-exempt H1B 因为state government不
属于cap exempt organization 而只有federal government才算，可这USCIS压根没提
federal的字眼，请问在哪里能找到USCIS的官方信息关于不能从cap-exempt H1B转到
cap-subject H1B从而用反例来反驳律师的观点啊？

，所以就开始办理了waiver。
DOS已经收到了NOS，一直处于pending状态。
今天放假，闲来无事查了下DOS系统，发现No objection菜单仍然是pending状态，但是
advisory opinion菜单Decision变成了Not subject. 请问过来人这是怎么回事？系统
错误吗？谢谢 |

拿过J1的话485交的时候好像就几种情况
initial decision说不subject，应该直接就不用管
说subject，可以 1) 拿waiver 2) 拿 advisory opinion证明其实不subject 3) 用出
入境戳+工资证明或者学校成绩单证明这段时间确实呆在home country

我觉得pca可以做这个，但是pca最后给我大约10个principle component（~90%

Only AO shows you are not subject to 212(e), you do not need J waiver,
otherwise, you are still subject to 212(e) if you were born in China-
mainland.
See DOS website and many old posts on this board.
If you think 8 weeks is waste time, you can start your J waiver right away. |

1。要求提供syllabus，但是中国成绩单和课程设置里没有这个东西啊，就算有难道得

这只有大学的，不提供高中的学历成绩证明可以吗？

这个subject Analysis还真是麻烦，但是我在新泽西，CPA只接受它，不接受其他评估。

数学系的同学，例如分别挑100个人来考试，一多半考不过考工科的。
不管哪科估计都差不多。当然做研究是另外一回事。
Math Subject现在恐怕不简单了。
我的一位去了美国Top 5数学系的同学，数学基础相当好。他准备Math Subject只
是看了看考试指南和往年题目，结果连90%都没有考到。当然他应考准备不足，但是他
本身的水平已经很高了。考后他表示难度超出预料。
认真准备确实会有一定效果，不过本身数学基础不好的人，想考到特别高的分数(
例如97%)，恐怕是非常难的。 |
