from same school.
master的论文没有在OPT过期之前交上去。学校DSO认为我not eligible for OPT
extension. 我仔细看了学校的instruction和USCIS上的信息。要求三个：1. On post-
OPT 2. Have a B.S. MS or PHD STEM degree 3. E-verify employer 4. File on
time(OPT没过期之前我e-file I765). 以上条件都满足，唯一就是没有提到学位必须
是Post-OPT时的学位。
即使没有master学位， 也应该可以extension. USCIS上只提到“Thus, for example,

发帖数: 1252 | 7 把我的情况再说一下，好让之前没有看到我文章的朋友们了解。2008年10月申请NIW（
PD），2009年底批准。2009年4月申请EB1a,2010年1月RFE后被拒。 2012年1月排期到了
和lg一起基于NIW被批准的140递交I485，后来陆续收到EAD和AP。我本人没有申请EAD，
还用H1b。都是DIY。
今天收到cis的正式拒信了。原因让人气愤。说是根据USCIS的纪录，我的I140表在2010
年1月被拒了，所以我不具备递交485的资格。我把信录了一遍在下面，请大家给看看是
不是这个意思。
他们一个不负责任的错误，我们就又得打仗似地应对，人力物力财力。觉得挺委屈的，
运气怎么这么差。身体、工作、孩子的原因，本来就疲惫不堪了，结果这样少见的事情
还让我们遇见了。而且因为我DIY，现在都不知道该怎么办，是自己弄还是请律师，是
reopen还是reconsider还是appeal，有什么区别？肯请大家帮帮我给出出主意吧。先谢

最近考虑换个工作，跳之前想确认一下可以保留PD。作了一些research，能找到的最权
威的条文是state department的notes(9 FAM 42.53 NOTES)，我找到的版本是11年10月
27号的，其中第五页是这样说的：

“These categories serve as reminders that an I-140 may be filed multiple
times with the same PERM approval. The first time the I-140 is filed, the
original PERM must be submitted. However, subsequent filings will be "
Amended Petitions" and do not require the original PERM.

今天，我们来到这里，花了多长时间？一小时？两小时？对我而言，是漫长的 20
年！20 年前，我满怀理想踏上了这片自由的热土。或许，是因为听了太多的美国之音
吧。20 年后，我的儿子却与我一道，并肩抗议 ABC 传播种族仇恨和暴力的言论。这幅
场景有多么不和谐？
我问儿子，是否权且将“杀光中国人”的说法当作一个笑话。他说，这种言论表明
，社会和媒体都在给孩子们灌输什么样的理念！我心沉重：美国是进步了，还是倒退了？
现在，我再次询问：我们走到这一步，花了多长时间？
