AA是推动diversity的executive order. 你做任何事情, 这个都不能
拿来做法律依据. 比如, 你把学校的白人杀一半, 说我这是因为AA要推进
diversity, 就合法. 是, 确实diverse了, 那是不是笑话?
或者, 你不喜欢AA, 只要你的录取/雇佣标准透明清楚,
就算你全雇白人, 别人如果在你雇用标准与过程里找不到问题,
也不可能拿AA去告你.
所谓"人家实力比你弱，就可以名正言顺被录取和聘用", 那是具体
执行的人做的, 除了类似判例中说的那种"narrowly tailored"的特例,
一般人如果明确承认实力比你弱, 是不可能仅靠AA就"名正言顺被录取和聘用"的.
人家一定会找其他的名义被录取和聘用. |
