of Marriage Act, or DOMA)违反宪法。
Tauro的判决基于两起案件：麻州公共卫生部对联邦人民健康事业部；Gill等伴侣对人
员管理中心。

麻州公共卫生部对联邦人民健康事业部
-2005年麻省通过了同性婚姻法
-由大律师Martha Coakley代为起诉，该州就DOMA起诉联邦人民健康事业部
-DOMA在联邦范围对婚姻作定义：“对‘婚姻’的定义为一名男子和一名女子之间的法
律结合，并称为丈夫和妻子。”
-麻省基于宪法第十修正案对DOMA起诉。该修正案规定此权力不属于联邦政府而属于各
州和人民。
-麻州认为联邦没有权力使DOMA生效。
-麻州还认为DOMA干涉了州政府如何花钱
-法官Tauro的判决支持麻州，他认为DOMA对婚姻是否成立的定义剥夺了州对婚姻定义的
权力，也因此损害了联邦的法律权力。只有州政府有权力定义该州的人是否结婚。
-换名话说，国会越界地制定了该法律--这在美国历史上是首次--联邦政府可以决定什

July 08, 2010
Today, U.S. District Court Judge Joseph L. Tauro ruled that Section 3 of the
Defense of Marriage Act (DOMA) is unconstitutional with respect to claims
brought by seven married same-sex couples and three widowers from
Massachusetts. Under the ruling, the plaintiffs are entitled to the same
federal spousal benefits and protections as every other married couple.

As I understand it, these decisions apply only to Massachusetts. However, if
they're appealed and the circuit court upholds them, that ruling will apply
to the entire circuit. If the US Supreme Court also upholds, it will apply
to the whole country and Part 3 of DOMA will be history. Meanwhile, other
courts will consider Tauro's rulings in future decisions. F |

GLAD的律师很清楚地表示，即使DOMA被最高法院推翻，Prop8还要慢慢地走它的上诉之
路。（除非有全民投票或其他的方法）
“Prop8是一起婚姻案，它是讲人们在州里被剥夺了结婚权；我们的案件是在州一级已
经被承认结婚的人在联邦一级也得到承认。”Bonuato说，“我们的原告们已经结婚了
。”
但是LGAD的律师说这并不会损害Prop8案。现在想要联邦法官对Prop8作出相似的决定--
对DOMA作出的决定性--是没有用的。
支撑8案，因为要走更大的地区，第九区，要在判决前走很长的路。不大可能prop8案和
DOMA案会同时到达最高法庭。
GLAD律师认为，如果两起DOMA案到达最高法院，它们不会是党派间的决定，因为它是联
邦制度的问题，也就是说国会过度立法，将州法的权力剥夺了。

十二星座（或黄道十二宫）的名称都来自拉丁文。第一个白羊座，Aries是拉丁文的“
公羊”。在希腊神话里，这只公羊长着金毛，背着Phrixus和Helle两姐弟，逃避他们的
