东西太少了，基本上就是魏如萱在用中文翻唱几个indie pop小乐队的作品。主打歌居
然是Torte Bus的Sunday Trip和Mondialito的Page Blanche。其实翻唱并不是问题，但
是这种不改编曲只换中文歌词的港式翻唱法，恐怕很难定义为独立音乐吧。 |

breach of duty is not easy to establish, too. The standard to be used
on judging whether a doctor has breached his duty is comparing his
conducts with those of an average member in his profession in similar

1976年，JERRY BROWN上次当加州州长的时候，通过了一个法律MICRA，基本意思就是说
医疗事故的案件，赔偿要封顶，不然医生医院承担不起。
好嘛，根据当时的行情，给加州所有的MEDICAL MALPRACTICE案件的GENERAL DAMAGE定
了一个上限：25万美元。不管你是被医生，医院，或者护士疏忽给弄死了，还是变成终
身残疾，或者植物人，永久丧失性功能，浑身长疮生不如死，等等等等，那个不负责任
的王八羔子对你或者你的未亡人的责任，就是25万，哪怕他的保险额度远远高于这个数
字，哪怕愤怒的陪审团听完证据之后一致判决医生赔偿1000万。尘埃落定之后，苦主的
一纸判决书上，数字都会被降到区区25万。
这下好了吧，医疗费用应该稳定了吧。毕竟就算他们捅出了再大的漏子，责任都是封了
顶，有保险公司来赔的。
更何况，就这么点赔偿额可以争取，贪心的律师哪还有什么兴趣去求告？一场医疗事故
的官司打下来，少则两年，多的四年五年，时间精力钱财的投入，和这可怜巴巴的回报

will not be as good as a reasonable person. So...
As for manslaughter, you need to be reckless or criminal gross negligence.

我的看法：
1. 这个时候召回， 不是好现象。
2. 如果领导谈话提到这个事情。 绝对不是好现象。在性质上， 王卷入这件事
已经跟工作有了交集！ （如果领导不在正式谈话中提起。 说明这个事被限制在私人事
务范围)
3. 王参与孙的网络漂白行动(2006)。 即使她当年是无辜的。 也是主动参与到
舆论中来。 那么现在更多的曝光是她自己当初选择的结果， 没有什么值得同情的问题

昨天开车的时候，在一个岔路口（有stop sign,我是在主干道上开车没stop sign)不到
20米的地方一个小黑孩旁若无人的骑车冲了出来，看那速度根本在stop sign前没停，
幸好我猛踩刹车按喇叭，总算没撞到小孩。
后来想想，幸亏我反应快车速也很慢（45mph），不然小孩早上西天了。
这里有个问题，要是我正常行驶不超速，努力踩刹车（in good faith）但还是把小孩
撞死了，我需要负责吗？（民事赔偿或者manslaughter之类的过失杀人罪）？
