看了一下,G哥的理由说得很清楚了。他的部分比较长,就不全部贴,关于一个某人特
别关心的safety问题,G哥的回答是这样的:
...It might be fair to ask whether TransAm’s decision was a wise or kind
one.
But it’s not our job to answer questions like that. Our only task is to
decide
whether the decision was an illegal one. The Department of Labor says that
TransAm violated federal law, in particular 49 U.S.C. § 31105(a)(1)(B).
But that statute only forbids employers from firing employees who “refuse[]

Maddin reported the frozen brakes to TransAm at 11:17 p.m. and was

transAM在司机入职是都交给一个trailer lock,(不是锁车箱门,而是锁trailer和
tractor的链接处,保证trailer不被别人拉走), drop trailer 不仅是常规做法,可
以接受的,而且公司也做了准备的。
是dispatcher瞎指挥并故意威胁司机的生命安全,dispatcher应该承担责任甚至刑事责
任,司机是受害者。
公司没有处罚dispatcher而处罚受害者,因为这些dispatcher是transAM 诈骗系统的成
员,欺骗司机是公司交给的任务。

记得有离职dispatcher留下的review,就是TransAM强迫dispatcher对司机撒谎欺骗类的。
其他人员似乎还好些,在transAM 工作过的司机,提起这个公司基本都是咬牙切齿。

施耐德,美国最大的卡车公司,有15000辆车2万司机。
养几千台semi truck的只能算中等规模(如conway,JB HUnt, TransAM等一大批),当
然还有一半的卡车属于少于五辆车的小公司(small fleet/owner operator)。
有规模才有效益。

他要冻死了就遵守公司指示了。
坐在办公室的官僚们(dispatcher等)基本都没在路上工作过,很多是瞎指挥的,公司
要做的是开除那些发指示的官僚。本案显然是官僚的渎职造成,却让受害者当替罪羊。
本人了解transAM, 基本是靠骗招司机, 而那些官僚,是其诈骗系统的分子,是自己人
要保护其渎职行为。

这些法官律师议员的逻辑怎么都钻到那么几个字眼上啊。大家看这种说法是不是经得起
推敲:
TransAm应当强调fire的原因和"refuse to operate...." 完全没有关系。因为存在许
多其他方案 in which 这个driver不operate truck/trailer公司都不会开他 - 比如原
地待命,比如叫救护车来把自己带走,比如把trailer留下但是做好保护措施 (公司强
调过这个driver把trailer留下没有任何emergency sign/light标志是illegal的,但完
全被ignore)。公司完全有从职业准则角度开人的自由。

一月的IL(I-88上,应该至少在芝加哥北), 半夜十一点到一点多,是啥温度用脚趾头
都能想明白,还提南方的室内温度。英文水平放一边,常识有吗?
TransAM 是最垃圾的公司,对雇员的欺骗臭名昭著,这个法官可能也跟你们一样缺乏常
识。

he was unable to find the TransAm-mandated fuel station导致没油,应该是公司
提供了错误信息(要求到一个不存在的加油站去),否则不会发生,因为能让卡车加油
的truck stop都很大,不仅GPS搜的到,主要高速上也都有标志。

本人绝不是左X, ID也没有被盗,指出点你们的常识错误。
本案显然是dispatcher渎职造成,但dispatcher是transAM诈骗系统成员,所以只能让
受害者承担后果。
