EB23闹成这样有失体面，在于我只注意了AP的便利性（H1B也可以往返，并非生死问题
）和EAD可以让配偶工作，而忽视了EAD的另一个重要性。经过某些EB2的再教育，体会
到了为什么EB3应该全力阻止EB2降级。
其实最重要的是EAD的一项功能。根据AC21法律，在485上交180后，不仅仅可以换工
作（前雇主撤掉140也没关系），还可以在失业的情况下保住身份，重新上路。那么485
就不是所谓锦上添花的效能，而是可以和绿卡比肩了。
基于此判断，我鼓励所有的EB3使用各种方法保住自己的排期，坚决阻击EB2的降级。

我刚刚从一个临床试验专业毕业。也学过一些US FDA的相关法律。谈谈我的看法吧。
现在全世界的临床药物实验在国际上是有相关的规范的，这个就叫做ICH Good
Clinical Practice.如果大家去看一下这个规范的历史由来就会知道为什么临床试验是
如此的重要：历史上由于缺乏有效的临床试验的监管，出现过大大小小的事故。这个规
范的出现一是为了保证在试验过程中对参与实验的人的安全和权益做出保证，第二就是
对上市之前实验中的药物/器械的安全性和有效性做一个客观的评价。我个人认为就是
要给消费者和医生一个信誉的保证。美国是推出这个规范的组织 ICH的创始国之一。这
个规范现在被大多数国家，特别是发达国家所采纳，但是各个国家根据这个规范出台的
法律和政策会有不同。可以说这个规范建立起了全世界通行的临床药物实验的管理框架。

2.俺的AGENT说如果想买到这个房子，最好递个FULL PRICE OFFER.对SHORT SALE没有经

Very speicific explaination on
1. processing of I-140 and I-485 applicatons under the I-140 portability
provisions of AC21.
2. processing of unapproved I-140 petitions that were concurrently filed
with 485 applications that have been pending 180 days and a RFE has been
issue.
3. processing of H-1B petitions under the extension provision of 106(a)
allowing extenion past the h-1b 6 year limit.

Your EB1 I-140 is approved, so your I-485 should be approved unless you have
unapprovable conditions (a.k.a inadmissible)
And even if your I-485 is approved, there is no 能够确保成功 of her I-485.
Most likely she may need to be interviewed to verify true marriage. |
