这幅图画（约在1872年）由约翰·贾斯特（John Gast）绘制，名为《美利坚向前行》
（American Progress），为昭昭天命的一种寓言式表现手法。在图中，一个天使般的

现在纽约地区审查官(或者 DMV 官员)没有起诉肇事者，其实不是他（她）的错，而是
因为纽约州市刑事案件的标准问题。不同于其它州，纽约的有关汽车杀人的法律比较特
殊：如果司机驾车杀人，只对酗酒或吸毒的司机起诉其“驾车杀人”罪或“凶杀”罪。
如果想起诉“过失杀人”罪，必须证明司机在肇事的时候是“罔顾后果”地在开车（
reckless driving）；这是一个比较难达到的标准；而在其它州“过失杀人”罪只需证
明肇事者和其他普通司机相比，开车时没有“合理谨慎”地开（fail to exercise
reasonable care），这是一个较低的标准。因此，地区审查官(或者 DMV 官员)在这个
案子上也是照章办事，无能为力。
