不過在我發現我犯了低級錯誤以后我倒回去看了一下這兩個案子的判決，
和這兩個案子的writ petitions。
紐約的這個案子，判決認為Windsor有standing，
但writ petition質疑BLAG是否有standing。
看了半天，我還是覺得standing不應該，也不會是主要的焦點。
gay marriage right 肯定是焦點，否則止步在standing的問題上，
大家都會很失望，也不是高院想來想去挑了這兩個案子原因。
當然，如果高院說BLAG確實是閑得蛋疼，沒standing，
那第二巡回法院的windsor判決就成立，
DOMA sec 3 還是違憲。 |

高院會回答三個問題，焦點是doma sec 3 是否違憲的問題，
剩下兩個問題不是Windsor案的重點，
BLAG有沒有standing，放在最后帶過就好。有沒有都不重要。
Solicitor General 是代表聯邦政府的律師。
certiorari petition 是申請judicial review 的申請，
也可以叫writ petition
全稱 petition for a writ of certiorari before judgment
按后來我重新翻書的理解，在standing的問題上，如果BLAG沒有standing，
高院就不用裁決正經問題，政府沒standing，Windsor贏，
維持原判，DOMA sec 3違憲，
這個判決就簡單多了，但高院這么做就顯得太偷懶了。
就不糾纏standing的問題，高院的裁決結果必定是推翻DOMA sec 3 的，
我對此有百分之九十九的信心。
你說的移民福利，在宣布DOMA sec 3 違憲之后，
同性伴侶享有移民福利-聯邦福利。
非移民簽證移民簽證結婚綠卡，應該都享有，與異性夫婦無異。

学校都挺好的， 到纽约都是火车65分钟。
Westport亚裔很少, 00年的数据， 亚裔2.4%, 中国人1%， 现在不知道有多少。
West windsor亚裔很多， 00年的数据， 23%的亚裔， 中国人8%, 10年亚裔涨到了38%
， 除了中国人有大量的印度人。
Westport房子老且贵， 同样的预算在West Windsor可以住大房子， 在westport只好住
小黑屋。 |

发帖数: 174 | 24 South windsor 镇上中国人也不少，但是谈不上居住比较集中区域。比较新的房子在镇
的东北部和东南部较多，比如buckland hill 北边那块地方，你自己研究一下Bing地图
bird view就知道了。另外也有开发商在造新房子。这个镇规定single family house
至少要有半亩地，但是也有很多Lot很小的condo性质的房子。大部分地方都通天然气和
上下水。
在Hartford以北，若想有decent的房子，decent的学区，交通方便，购物方便，有一定
的华人社区，south Windsor是很好的折中选择。 |

发帖数: 20256 | 28 叫你姨妈在windsor的turnel bus总站上车，google一下，车站离tunnel入口不远，但
是也不近。tunnel bus在detroit和windsor的有不少stop，google一下就知道。 你自己到GM大楼找个parking停好车，到tunnel口的tunnel bus stop等着。
叫你姨妈过关后，上bus,一出tunnel的bus stop就下车。这样就可以接到。回去windosr这样做也没问题。我不知道是不是最方便的方法，但是没问题。另外，也可以坐灰狗，你到灰狗站等。
桥就不要走了，那里在construction。
基本上无论在哪里，你都看不到对岸。在tunnel的话，你可能可以在tunnel bus stop附近看到tunnel bus load和unload过美国海关的乘客。乘客必须进office里接受检查证件。 |

library, which are not far from East Windsor. You can have your Mercer
county libary card stamped so you can check out books from Plainsboro
library, too (good Chinese collection of books).

一二十年前也是一个好地方。
现在west windsor也是这样一个好地方。 十年后也会成为edison吗？ 也许不会，
因为房价地产税高。但现在往里面走的机会都是老中烙印。
Plainsboro基本已经是另一个edison了。 烙印老黑占一半多了。

开1号公路，

个town，主要是考虑学校和daycare， 请了解那里的同学给些建议， 谢谢！
West Windsor： 小学和中学都是10分，daycare 找了Goddard 和 The Learning
experience 还行，感觉老印没那么多，有大的shopping center， 生活方便。
Plainsboro： 小学（Millstone rive） 9 分，daycare 找了几家Montesorri, 觉得都
不怎么样，没什么老中小孩在里面， 奇怪老中的小孩都送哪了，烙印是乌泱一大片。
大部分房子都挺旧的，可能我没有到新区。 有美东，方便。
请问两个区那个区的中国人比较多，更适合家庭生活？

因為在她成為大法官之前曾經參與了麻州的那三個案例的訴訟程序，
也許這是高院拖了一周才決定的原因，
把麻州的幾個案子排除在外，讓第一巡回法院的判決成立，
反而把紐約州Windsor的案子納入考慮，
這樣一來Kegan不需要回避，不會出現判決結果4-4的僵局，
至于為什么接了Prop 8，就不知道是不是因為公投的問題，
畢竟推翻公投的結果是很嚴肅的事情。
我估計3，4的結果有可能，高院只能針對這幾個問題作出回答，
還有一種可能是高院認為defender有standing，因為代表公民投票的結果，
而推翻公民投票的結果對民主程序有害。
但是就算有standing，按照憲法第十四修正案的平等原則，
Prop8 本身是違憲的。加州的同婚應該合法。
推動同婚至全國范圍則不是高院的風格。
也不是這兩個案件提出的問題。 |

选举再次公投repeal proposition 8基本不成问题。The Windsor case涉及到联邦权益
，其实于我们海外同志切身利益联系更为紧密。但是散兄，高院一定会对这个案子中涉
及DOMA Section 3是否违宪的问题作出回答吗？如果高院认为纽约的Case也存在
Standing的问题，维持circuit court的原判，是不是意味着那仅仅代表一个个案的胜
利，像前面同学说的那样不会切中Section 3要害，最后不了了之了呢？ |

amendment的equal protection,是不是法官只会从这个方向去讨论，他们还会不会考虑
10th amendment关于限制联邦法律，因为婚姻一直都是state issue而联邦干涉就是违

另一个是，如果维持district court的判决，那就等于是说doma在district court 判
