1.Both my husband and I were in OPT from 2/1/08 to 9/30/08 and then changed
visa status to H1 from 10/01/08. Before 2/1/08 we both were international
student, I came in 2/2003 and my husband came in 12/2004, if we want to fill
joint which form should I do, 1040 or 1040NR-EZ?
2.We both got deducted on social security tax and medicare tax from the
employer which we shouldn’t during OPT, I know I can file form 843 to claim

with 1040 cause 1040NR doesn't givey you standard deduction or exemption(
one of the two).
you should probably need to talk to your employer before you file your own
843.
1040 has nothing to do with social security tax and medicare tax. I'm not
