Immigration is not comfortable with independent contracting (which is the
reason for the 1099 rather than a W-2) because their assumption is that you
are not getting mentoring by colleagues and fellow professions but rather
are just doing unsupervised employment.
Because you are not getting a W-2 nor are taxes being withheld and paid in
your behalf, you are expected to pay U.S. Federal, California State, Social
Security, and Medicare taxes on your own. This is a very complicated thing
to do (which is why the employer is transferring the responsibility to you
since he/she/they don't want to do it). The only thing they report to the U
.S. Internal Revenue Service (IRS; our taxation agency) is the gross (or
total) wages they have paid you during the calendar year (1 January through
31 December). From this reporting (which identifies your name and Social
Security Number), the IRS will be auditing your tax return to make sure you
have paid your share of the taxes. Not paying can lead to fines (minimum)
or jail (if determined that you are legally charged with tax evasion).
In conclusion, this is not a good thing for you and I would recommend you
not take this position. Obviously, you have a work permit that allows you
to work in your field of study but you are required to pay your share of our
taxes and to not do it makes you illegal. |
