上了前面了车，然后又被pickup撞了一下，于是乎车溜到了前面那车的右边，我的车左
侧和该车右侧有
刮擦，现在对方保险公司结果出来了，说他们不负责我左边的damage, 请问大家我现在该怎
么和他们
argue这个事情呢？是不是那个insured's negligence是受到法律保护的？
另外，如果就按这么赔偿的话，他们会怎么估价？是原车的价值减去左侧damage的价值，还是左侧破损
之后的这种车况下的价值？
以下是保险公司发来的邮件：
Your vehicle has been assessed as a total loss. I have sent this to the
total loss department to determine the value of the vehicle.
We are accepting 100% of your front and rear damages, however I cannot
accept the damages to the left side of your car as resulting from our
insured’s negligence. There may be some reduction to our offer because of
this, however I cannot quantify it at this time.

My suggestion to LZ, consult a lawyer. He/She will be very happy to help you

There is a recent note in the file, the vehicle may not be a total loss.
The total loss adjuster is waiting for confirmation from the auto adjuster
that the vehicle is a total loss. Also the damage to the left side of your
car needs to be adjusted by the automobile field adjuster. I will continue
to monitor this for you.
这不是坑爹呢嘛。。怎么会确认了total loss还能改？ |
