Report: Video shows man accused in road-rage shooting passing victim
Video shown at the murder trial for Martin Edward Zale, accused in a road-
rage shooting death, shows Zale's truck passing the victim's vehicle and the
victim then approaching Zale, according to a report by the Daily Press &
Argus.
Zale is charged with open murder, discharging a weapon from a vehicle and
two counts of felony firearm in the shooting death of Derek Flemming, 43, of
Oceola Township.
Flemming was killed Sept. 2 during an incident of road-rage driving after he
approached 69-year-old Zale's vehicle on a Genoa Township road, police said.
Video surveillance from a nearby gas station shown at trial May 6 shows a
blue pickup truck passing a silver Ford, the newspaper reported.
Amy Flemming, Derek Flemming's widow, testified that Zale's truck was
following them too closely and then passed them before its driver slammed on
the brakes at least twice, the Daily reported.
Melissa Pearce, Zale's attorney, said in her opening statement that Flemming
continually tapped on his brakes and Zale pulled away from his vehicle,
according to the newspaper. She said Flemming went through a red light to
follow him.
She has said the shooting was an act of self-defense and that Flemming
punched Zale, according to previous media reports.
Other video shown at trial showed Flemming's legs as he walked up to the
blue pickup, the newspaper reported.
Trial is expected to continue on Thursday. | d********g
