DCF barged into my friend's house with four policeman and took her three
children into custody today. This was at 3pm on a schoolday without ever
showing a warrant or a court

I have been curious over the past several weeks about Boston Children’s
Hospital (BCH) ever since I first heard about Justina Pelletier’s case, the
15 year old who last year was taken to BCH on the advice of her physician
after becoming ill with flu symptoms. Once at BCH, Justina was reportedly
removed from her parents’ custody by the Department of Children and
Families (DCF) when a disagreement arose about her diagnosis.
You may recall that her parents informed BCH that Justina was being treated
by Tufts Medical Center for mitochondrial disease. BCH, according to
reports, felt that she had a somatoform disorder. A somatoform disorder is
a mental disorder rather than a medical issue.
I began conducting research so that I could determine whether Justina’s
case was just an isolated case or if other cases, similar or dissimilar to
her case, were frequently occurring at BCH.
I quickly discovered information that had already been discussed in the news
and some information that was not so readily available.
One such case was that of a 14 year old girl from Switzerland. The facts of
this case are somewhat different from Justina’s case but nonetheless
disturbing. As far as I can tell, DCF was not involved.
It appears that in 2012, a 14 year old girl was held by BCH for six weeks
after overdosing on Xanax, while refusing to return her to her Swiss mother.
Instead, upon discharge, BCH allegedly returned the girl to the woman that
had potentially supplied her with the Xanax in the first place.
It took approximately six months for the mother to recover her daughter
after filing a petition with the court under the Hague Convention of the
Civil Rights aspect of International Child Abduction. The mother sued BCH
for failure to provide a safe environment for her daughter by returning her
to the woman who had allegedly supplied her the drug in the first place.
The mother further alleged that BCH ignored red flags about this particular
woman and the drugs that she may have been prescribed because of a mental
disorder. She further alleges that when she refused to pay for BCH services
and demanded they return her daughter to Switzerland, BCH turned the girl
over to the woman who was not her parent, in support of separating the girl
and her mother.
Another case that I found was that of an adult male with physical
disabilities. He reports that his disability requires him to use pediatric
medical equipment. Due to his particular need, he was taken to BCH in May
2008 because of a lower intestine blockage. His report states that he had
been seen by Boston Children’s Hospital’s specialists since 1968.
On this occasion, BCH refused to give him medical care, according to the
male patient. He claims that the adult hospital where he was referred “
begged” BCH to take him but allegedly BCH refused medical treatment.
As a result, according to the patient, he received a broken nose from adult
size tubes, neck and spinal damage from the tubes placed down his throat,
and PTSD from being awake through the entire procedure. He continues on to
recount more unpleasant procedures, to say the least, that were used on him
and the resulting damages from his ordeal.
He then alleges that BCH rewrote his medical records to make it appear that
he wasn’t in any pain or medical distress when he visited the emergency
room.
elizabeth wrayThen there is the Elizabeth Wray case. In early 2012, a 16
year old girl from New York who was diagnosed with Pediatric Autoimmune
Neuro-Psychiatric Disorder Associated with Streptococcus (PANDAs) sought
treatment at BCH. Once at BCH, she was reportedly re-diagnosed by BCH.
When her parents disagreed with the new diagnosis, her parents indicate that
BCH reported the case to DCF and Elizabeth was subsequently removed from
the custody of her parents. A gag order was then put in place and her
parents could not speak to the public about what was occurring. This case
appears very similar to Justina Pelletier’s situation. Reports showed that
Elizabeth’s health deteriorated, as has been reported about Justina. She
was finally returned to her parents in August 2013 after a long court battle
to regain custody.
Another report that I came upon during my research indicated that in an
eighteen month time period, BCH allegedly took or threatened to take five
kids from their parents’ custody by referring the cases to DCF.
Yet another report claimed that BCH had helped to remove six children from
their parents by reporting the cases to DCF.
I also discovered another case about an 8 year old boy that was taken to BCH
in February 2013, according to his mother, for kidney failure. The mother
’s report indicates that the boy’s Pittsburgh doctor had vouched for her
fitness as a mother. However, in March 2013, BCH allegedly reported the
case to DCF and the child was subsequently placed up for adoption. Per the
mother, she eventually fled to New Hampshire with her other child to keep
DCF from taking her daughter, as well.
I also found a warning, allegedly from a woman by the name of Sara K. living
in Jamaica Plain, Massachusetts, who wrote a comment on Yelp in October
2013 about her experience with BCH. She claims that she took her infant to
the emergency room at BCH to seek a second opinion on an X-ray. She went on
to state that she and her husband had felt wrongly accused by BCH and that
BCH had threatened to take their baby away.
These are just a few of the cases that stood out for me. I have heard of at
least 2 other cases involving children claiming wrongdoing on the part of
BCH.
Early last month, it was reported that the Department of Public Health will
investigate complaints about BCH. After conducting this research, I can
only ask what took so long for the investigation to occur.
BCH represents one of the nation’s largest pediatric research leaders,
according to a ZipTrials article. It was reported by ZipTrials that BCH
receives more federal funding than any other pediatric research institute in
the country. There are over 1,000 scientists and innovators that tackle
childhood diseases at BCH. Further, according to the article, BCH is
consistently the top ranked children’s hospital by U.S. News & Health
Report. It specifically excels in specialties that include gastroenterology
, the specialty that Justina Pelletier was seeking when custody was removed
from her parents.
There has been much speculation lately as to why BCH is allegedly taking
children from their parents by reporting them to DCF if they disagree with a
BCH diagnosis. One theory is that this is being done because of the
extensive research and funding that BCH receives from the federal government
and elsewhere.
After conducting my research, I had another question and perhaps another
possible theory. Was mitochondrial disease and the treatment for it covered
under Justina Pelletier’s insurance plan when she was admitted into the
hospital? What about the insurance plan of other children at the time of
admission into BCH?justina
House Bill 977 was introduced in Massachusetts around September 2013 which
requires all insurance companies in Massachusetts to cover mitochondria and
its treatment costs which can be expensive. If this disease was not covered
under Justina’s insurance plan in February 2013, who would benefit by
changing the diagnosis to one that was covered under her insurance plan?
Keep in mind that this is only a question. I have no evidence as to whether
Justina’s disease was covered under her insurance plan or even if she had
insurance at the time of admission. I also do not have evidence to show
that BCH did any wrongdoing. Whether BCH is a name that we can trust will
hopefully be examined more thoroughly in the weeks and months to come.
In the meantime, while it appears that some headway is being made in
bringing Justina Pelletier home, the fight seems far from over. We must not
grow complacent in thinking that this case is all wrapped up and that
Justina is on her way home. That is not the case as of the writing of this
article. We must keep up our efforts to bring Justina home and to make sure
that justice is served in all other cases of children who may have been
wrongly removed from the custody of their parents. #FreeJustina

What I discovered was not what I expected to find. I was also not expecting
to be outraged!
In 2010, Children’s Rights, a New York based non-profit organization,
advocating for the rights of children, filed a class-action lawsuit against
DCF. Children’s Rights alleges that thousands of children in DCF’s care
suffered neglect, abuse, and even death in some instances.
More specifically, in the class-action lawsuit of Connor B. vs. Patrick,
Children’s Rights represents 8,500 children who were allegedly abused or
neglected while in DCF’s care.
The lawsuit:
“Charges the state’s Department of Children and Families (DCF) with
violating the constitutional rights of children by routinely placing them in
dangerous and unstable situations once removed from their parents’ care
and failing to take necessary actions to meet the legal obligation of the
state-run child welfare system to ensure the safety and well-being of
children in its custody.”
The plaintiffs in the Connor B. case raised “concerns about the workload of
social workers, .., and the safety, care, and well-being of foster care
children and youth.” The case is still moving through the judicial system
as of this date.
I also discovered that 95 children have died since 2001 while under the care
of DCF. However, it is believed that the number is actually much higher
because the State did not report numbers of deaths between the years of 2011
to 2013.
african american childThe tragic reports of the children who suffered are
heart wrenching. Repeated warnings to DCF about child abuse fell on deaf
ears in some instances. Another incident concludes that a child was killed
after DCF failed to take the appropriate actions, and yet another report
states that a child under DCF’s care is still missing.
A report in 2010 showed that over all, children receiving services under the
care of DCF social workers were about six times as likely as the general
population of Bay State children to die from maltreatment, according to the
state’s own records. DCF was quick to point out that this was no surprise,
however, since they serviced those populations where the children were at a
higher risk to die from abuse or neglect. Doesn’t that describe the
population that a child protective agency serves in general? What if all
child protective agencies felt the same way as DCF about their statistics?
I also discovered a report by an attorney who wrote an article in 2012 about
Boston Children’s Hospital (BCH) and DCF with eerily similar facts to
those of Justina Pelletier’s case. It appears that the attorney
represented several parents that had children with “serious but
controversial diagnoses” who were in BCH and wound up being investigated by
the hospital’s Child Protection Team and DCF.
He cites one instance in which the parents brought their child to the
hospital just to be tested for mitochondria. The child had not been under
the care of a doctor for an extended period of time as in Justina’s case
and the parents were merely trying to rule out mitochondria. Justina had
been under a doctor’s care at Tuft’s Medical Center for approximately 1 &#
189; years and he was treating her for mitochondrial disease.
Due to an internal battle within the hospital team, the attorney’s client’
s case was turned over to the hospital’s Child Protective Team and the
mother was accused of Munchausen by Proxy. In other words, they were
claiming that the child was not really ill but that the mother was making
him ill in order to garner attention from others.
Olga Roche CommissionerAlthough the case was turned over to DCF, the outcome
was better than what has occurred thus far in Justina’s case. Fortunately
, for the family, the attorney happened to know the social worker well and
had worked with her in the past on other cases. Over several weeks, the
child began to improve on antibiotics and was subsequently released to the
parents’ custody.
I also discovered that a new lawsuit has recently been filed in January 2014
against DCF for the wrongful death of a toddler. In that case, the
plaintiff alleges that DCF ignored her warnings of abuse of her great-nephew
by his mother. Although, DCF had temporarily removed the child from his
mother’s custody, he was subsequently returned to her. As a result, he
died from blunt-force trauma. He further suffered from contusions of the
liver, stomach, and colon, as well as internal bleeding.
It would appear that DCF has a number of issues within its organization that
deserve close scrutiny. Perhaps their governor will become involved to
determine what is actually happening within the walls of DCH. In the
meantime, if you or someone you know believes that DCF has failed in their
responsibilities to care for children that have been removed from the
parents/guardians and placed within DCF’s custody, a complaint can be filed
by contacting www.mhlac.org.
