I searched all the Indian websites and found an interesting fact:
1.) Most of the PD 2007.07-12 received their NVC notice around April 9th,
around the May VB release date.
2.) Most of the PD 2008.01-04 received their NVC notice around May 13th,
around the June VB release date.
My conclusion is that:
1.) Mr.O noticed the huge EB1 spill over in April, but he was afraid of the huge
EB3-EB2 upgrade, so he only told NVC to send notices to 2007 PD.
2.) Mr.O noticed the EB3-EB2 upgrade is very small, so he notified NVC to
send more notices to the PD of 2008.
Additionally, I asked my lawyer about the NVC notice today. My lawyer said
that NVC has been very careful about these notices in the past. The reason
is that the $795 application fee can be expired if one case is not processed
within 12 months. Usually they only send notices 4-6 months in advance. Plus many Indians have paid this fee. It's no joke.
I suspect there will be a huge jump in the next VB. Let's keep our fingers
crossed. |

Visa Bulliten. I think Mr.O is updating NVC on a monthly basis.
I think it's possible they will send more NVC notices around the time when
the next VB is coming out. We need to keep monitoring the situation
In other words, it's possible they may get more people on board.
Just my personal opinion. Anyway, they will move PD into 2008 for sure.

It's possible they may send out more notices to the PD after April 2008.
I think DOS is evaluating the situation every month and notify NVC a monthly
basis.

I don't think that anyone outside of the State Department has a clue as to
future cutoff date movement in the short term. There are just too many
unknown variables. Perhaps the best indication is the interval we see
between when the NVC sends the fee bill and the individual's priority date.
Generally, the NVC does not send a fee bill until they estimate that the
person's priority date will be current within half a year. I randomly picked
three fee bills that we have received in the last few months to get an idea
of what the NVC is doing. In April, we got a fee bill for an India EB2
applicant with a cutoff date of September, 2007. In May we got one for
someone with a cutoff date in November. In June we got one for someone with
a cutoff date in January, 2008. When I get time, I'll go through all of our
fee bills and put together a list of the fee bill dates and the
corresponding cutoff dates.
Before anyone tries to use this for precise calculations, please understand
that the NVC simply makes their best guess. They could be off by months. At
the same time, they have access to the best backlog data available.

I think NVC/USCIS/DOS have discussed this plan a long time ago and they have
access to much more data than us. I think back to April they have laid out
the VBs for the FY 2012. Otherwise it does not make any sense to send NVC

NVC bills were sent out from April to June this year. We never saw any bill
notice after July.
The last bill I saw was April 2008. I think it's possible that they will
move PD to April 2008 in the next VB. Or they will move PD to April 2008 in
January VB.
But nobody is 100% sure about their next move!
CO is unpredictable. He may just move PD to Dce.2007, nobody knows!
