中间打过三次指纹。8月1号排期到了以后没有联系过议员，私下里认为没有必要。因为
换了工作所以有一封RFE，简单请公司律师写了一封信附上pay check寄出。

一下公司律师的Perm AC21 RFE Response的信，我贴在这里，希望有后来人可能用的上。再次谢
谢这个版曾经给我的很多信息！至于包子，我要着也没有用，一个人10个，前十九人请查收。

Dear Sir or Madam:
This letter is written in response to the Request for Evidence received
by Mr. XXX, in connection with his pending I-485 adjustment of status
application. I am authorized to confirm the offer of employment set
forth in this letter.
In connection with this Response to the Request for Evidence, please
find:
1. A copy of the I-797 receipt notice for Mr. XXX’s adjustment of
status application (WAC-XXXXXXXXXXXXXX), received by the immigration
service on July 2, 2007. This notice demonstrates that Mr. XXX’s
adjustment of status application has been pending with the immigration
service for more than 180 days; and
2. A copy of Mr. XXX’s I-140 I-797 approval notice (SRC-
XXXXXXXXXXXXX).
INFORMATION ABOUT YYY Inc

MR. XXX’S CURRENT POSITION WITH YYY, Inc
Mr. XXX has been employed by YYY since ZZZ. He currently serves in the
position of Software Engineer (previously titled, Senior Programmer
Analyst) and is paid an annual salary of $999999.
In this position, Mr. XXX is responsible for performing technical
analysis, design and software development using appropriate technologies
to support department and company objectives. He works with analysts to
define the functional and technical needs of an organization and
recommend solutions. He assesses available technologies to meet needs,
and then defines the technical specifications and designs. He develops
and modifies technology systems, and addresses functional, performance,
security, quality, operations and monitoring needs. He creates detailed
test scenarios, performs testing and analyzes results. He documents all
technology changes through the appropriate change control.
We have reviewed that job description for the position, Computer
Software Engineer, that was set forth in the approved labor
certification application and approved I-140 petition that ZZZ Inc.
filed on behalf of Mr. XXX. We believe that Mr. XXX’s current position
with YYY is substantially similar to his prior position with ZZZ Inc.
The primary difference in these roles is that Mr. XXX changed his
employer to YYY and the location of his current employment is in RRR.
QUALIFICATION UNDER AC21 SEC. 106(C)
Mr. XXX would like to continue his I-485 adjustment of status
application (“AOS”) pursuant to the AOS portability provision section
106(c) of AC21. Under the AOS portability provision of AC21, enacted by
Congress on October 17, 2000, certain foreign nationals are allowed to
“port” or move their employment-based AOS filing to a new job or new
employer, provided that the position is the “same or similar” to the
position they were originally sponsored for, and provided that their AOS
application was pending for 180 days or more.
Mr. XXX meets the criteria set forth to qualify for AOS portability
under section 106(c) of AC21 as follows:
1. Mr. XXX’s AOS application has been pending with the United
States Citizenship and Immigration Service since July 2, 2007, as
evidenced by the I-797 receipt notice, thereby meeting the requirements
that the AOS be pending for 180 days or more;
2. Mr. XXX’s current position of Software Engineer is similar his
previous sponsored position, Computer Software Engineer, listed in ZZZ
Inc. approved I-140 petition (SRC-XXXXXXXXXXX). Both positions involve
the design and development of software and are considered to fall within
the same occupational classification of Computer Software Engineers,
Applications.
CONCLUSION
As Mr. XXX meets the criteria to utilize AC21 portability for his I-485
application, we respectfully request that the Service approve his I-485
application as his priority date is now current. If you have any
questions regarding Mr. XXX’s application, please do not hesitate to
contact me.
