我们排期是2008年4月，等了差不多四年，想着终于轮到我们了。可是命运总是这么捉
弄人。ld现在的工作这月底结束，新的学校正在帮他办h1b transfer，可是人家牛皮律
师11月底告诉我们，他们因为圣诞假期的原因，不能及时submit他的case。因为中间会
有gap，坚持叫我们回国签证。就几天的时间呀！！！我们将于元月打包，带着全家大
小回中国，就更别提交i485了... |

师都说这个就一灰色地带，不差很长时间就不用太担心。
不管咋样，big bless! 也许回国签证非常顺利，赶在1月底之前就回来了呢。 |

went to work next day. But a few days should be fine.

后一天接上，其实我过了一个礼拜才搬好家去上班的。但是律师的确说这是灰色地带，
看移民局接case的人会不会在这几天上卡你。

I consulted with one of my friend who are immigrant lawyer. He said the
lawyers of this school is very very tough. They refuse anyone put hands in
their cases. They insisted to inform us to go back China even there is only
one day gap!!

even cannot persuade the lawyer of that school to let us stay here in case
USCIS would not check the proof of last paycheck.

for them for filing transfer. they replied us that the policy in this
institute is they cannot extent someone with contract less than 6 months,
but my LD's PI cannot provide the proof of financial support for this extra
6 months because his funding almost runs out. poor us!!

which is up to 60 days long. They said it is ok for that way but, first of
all, they should have the financial proof to go through the process of
extention.

发帖数: 478 | 17 是不是你们旧学校的H1B到期了和工作结束的日期是同期？如果H1B还没有到期，老板提
前teminate你的工作了，那么至少学校应该付出你们回国的路费，这是H1B应该享有的
权利。
如果是H1B和工作同期结束，那你们当时应该早点找工作。
一般来说，好好和老板说说，他都不用pay你，只是保留一下employment，真的不是那
么困难吧？其实，系里的BA就可以处理的，他们这样作，真的是一点都不为这些H1B
holder着想。唉。less |

我们学校好像十一月十号就不接case了，所以紧赶慢赶在10号那天交了，想起那几天也

发帖数: 753 | 24 No，his problem is, if his H-1 transfer is filed before his previous H-1
goes invalid, then he can start working for new employer before the H-1
transfer is approved. However, if there is even one day gap, he is out of
status and he have to activate the second H-1b by going out of country,
apply for h-1 visa (could be china or canada/mexico). Before the new H-1
transfer is approved and validated from oversea embassy, he is out of status
(which could be long depending on how fast the h-1 extension is approved,
and it might be a new H-1 application rather than transfer).
My company forget to apply H-1 extension for me. I have AP but I didn't
bother to renew my EAD. I don't think I am out of status (since I am in AOS
) but I can't legally work and have to wait my lawyer to file new H-1 and go
to Canada to apply visa.

The last question. (all questions should be useful to you).
Also, ask the previous school to buy an air ticket for both of you. (you
don't have to use it and you can't turn it into cash though). I believe they
are legally required to do so.
If only your previous employer can terminate you a few days later,
everything would be fine. I understand they are University and have to
follow the rule.
And I believe all university are slow. It is probably not the lawyer's
fault for delay the filing, probably it is the second school's HR.
