can find the date send out H-1B application on the receive notice. Keep your
last pay check to show that you leave the old company after the new H-1B is
sent out. |

We had exactly same conditon as you, but the lawyer in the new company
insisted that the person should keep his/her employment till recieving the
reciept for new h1b. At the same time, you can not submit your I485 when you
are out of status (gap between two employments).We solved the problem by
extending one more month in current employer.

: are out of status (gap between two employments).
Why ? I have to do this now... But the gap is from 1/1 to 1/3. Should I ask
them put me on may roll from 1/1 instead of 1/3? My last day with current is
12/31 this year. And will submit 485 on 1/3.

发帖数: 753 | 9 You have to ask them to put you on payroll until 1/3 at least, or ask the
new employer to put your start date at 1/1.
If your new H-1 is already filed and got notice. Then you MIGHT be ok to
start your new job on 1/3, but you have to make sure you already start work
with the 2nd employer at the time you file your 485.

date on 1/1. I don't think it would made them pay you more salary.
