basically released by USCIS Ombudsman's Office and talks about improving
quality in Extraordinary Ability and other Employment Based Petition
Adjudications.
However, the most interesting part is on Page 6 of the PDF document. Look at
the first graph where number of I-140 receipts filed at both TSC and NSC in
EB2 category have significantly gone down in 2008 and especially in 2009.
Number of EB2 I-140 receipts do pick up in 2010 and 2011 but many of the
2010 receipts were filed on the basis of PERM which were filed in FY2009 but
were approved only in FY2010 as most of the PERMS went for audits in 2008-
2009 and it used to take really long to get them approved.

This numbers are for EB2 category as a whole and not specifically for EB2
India or China. This could mean a good movement for EB2IC in next bulletin
and also in future as the demand may be less (bad economy, more companies
not willing to file GC, duplicate PERM, abandoned PERM, more scrutinization
etc.).
This may also explain the reason why USCIS has received much less
applications than they anticipated and that is why we might have seen that
phrase inserted in January VB.
Here is what January 2012 Visa Bulletin said,
D. CHINA-MAINLAND BORN AND INDIA EMPLOYMENT-BASED SECOND PREFERENCE VISA
AVAILABILITY IN THE COMING MONTHS
The China and India Employment Second preference cut-off date has been
advanced at a rapid rate in recent months. As previously noted, this action
was intended to generate significant levels of new filings for adjustment of
status at U.S. Citizenship and Immigration Services (USCIS) offices. USCIS
has reported that the rate of new filings is currently far below that which
they had anticipated, prompting an even more aggressive movement of the cut-
off date for January and possibly beyond. While this action greatly
increases the potential for an eventual retrogression of the cut-off at some
point during the year, it also provides the best opportunity to utilize all
numbers available under the annual limit.
Here is what the paragraph states which is located above the first graph on
page 6 of this PDF document.
First and Second Preference Adjudications Data:
USCIS provided the Ombudsman's Office data on EB-1-1, EB-1-2, and EB-2
adjudications, including receipts and approvals for the Texas (TSC) and
Nebraska (NSC) Service Centers. USCIS has experienced a slight downturn in
EB-1 and EB-2 filings over the past five years for both EB-1 and EB-2 (not
including National Interest Waiver petitions), with approval and denial
rates remaining consistent. Stakeholders report that inconsistent
adjudications have had a chilling effect on petition filings, which may
explain why receipt levels have dropped over the past five years and
approval rates
have remained constant, but other factors, including economic conditions,
may attribute to this change in filings.
This data is directly coming from USCIS Ombudsman's Office and there is no
reason to doubt it. This can really mean good news for 2009 and early 2010
applicants in EB2 India and China category, at least for near future.
