experience of handling the RFE for "proof of enter US" from Canada so
others can benefit from it.
We entered US via Canada in our own car and my I-94 was still valid. So, CBP
did not issue a new I-94 or stamp on my passport. When filling the 485, we
entered the true date. However, we should have just entered the date on the
I-94! This will not trigger the RFE. Imagine you were the IO at USCIS, what
would you do? Asking for evidence is un-avoidable.
So, we got the RFE for proof of enter and also proof of keeping valid status
while in US!
My lawyer is an experience one although he likes to delay at least one or
two days. His paralegal is the best. She never delay one second to work on
my case!
So, the lawyer and paralegal worked on a Affidavit and I signed it in front
of a notary.
Basically the statement declares that I under penalty of perjury here by
affirm that I entered On [day, month, year] by automobile from travel to
Canada. I did not receive an updated I-94 card or an entry stamp from the
CBP officer. Upon re-entry, I was still employed with my employer XXXXX.
That I have not left the United States since XXXX.
The lawyer also re-sent all of my H1B visa approval notices together with
the RFE.
In about 3 days after RFE is received by USCIS, my case and LD's case are

。可以用FOIA request从CBP获得这个记录。
