Dear XXX:
Thank you for contacting me to express your views regarding S.1983, the
Fairness for High Skilled Immigration Act. I agree that it is important to
ensure that individuals and companies follow the law when applying for a
permanent immigrant visa.
Like you, I believe that Congress must act to help workers hit hard by
the current economic situation, and to prevent further job losses. The
employment based green cards addressed in this bill, however, are
specifically designed to ensure that companies can only bring in high-
skilled workers from overseas if they cannot find these workers here in
America. It is worth noting that this bill will not provide for the
admission of even a single new foreign worker. The only thing this bill
does is to eliminate quotas that exist in our immigration system which will
transform our immigration system into a “first come, first served” system
rather than a system that looks to your country of origin in determining how
long you should wait for a visa.
When the employment visa program works as intended, it is a vital tool
for ensuring that American businesses remain competitive in the global
marketplace. Employers must first recruit American workers and, if American
workers are unavailable, can only a hire a foreign worker if they are paid
the same wages that comparable American workers are paid (in addition to the
cost of immigration and attorneys’ fees for filing an application).
Consequently, companies have no incentive to seek workers from abroad if
workers are available here at home. It is true that there are always
reports that some companies may be violating the law, but that is why I have
authored comprehensive immigration reform legislation that allows the
Department of Labor to audit companies who bring in foreign workers to make
sure they are not violating either the spirit or the letter of our laws. In
addition, I am working with my colleagues to include such language into
this bill prior to final passage.
The Fairness for High Skilled Immigration Act is being reviewed by the
Senate Judiciary Committee where I will closely monitor the deliberations.
