要做家庭作业补补课。 各位大牛支招，该怎么说服律师？

我的PERM已经递交过。而且140已经批了。 今天突然被老板告知当初的job
requirement 有问题。 好像是老板招来一个比我有更少经验的人，所以需要重新做job
market testing. 各位有这样的经历吗？
如果重新开始，我的PD是不是可以保留？
我的PERM开始时间大概是去年8月。12月递交140. 今年4月140批
准。 我自己职位没有任何变动。问题出在组里内部有人员调整。 一个同事从一个位置
换来做与我类似的工作，但是经验比我的job description 要求的要低。 公司legal觉
得这样不行，要重来。
律师的回复是：
Unfortunately, your supervisor found an individual that had below the
minimum requirements of the position that you were filed in. Therefore,
your PERM is not accurate.
现在不知道那是什么时候发生的事， 如果是我的job marktet test 期间，是不是要重做

At the time of PERM filing, if the position was set up using the absolute
minimum requirements of the position, the employer conducted good faith
labor market testing, and subsequently filed the PERM, and DOL has already
certified the PERM, then the PERM was done correctly.

保留。

发帖数: 87 | 5 我可能会有类似这样的情况，问公司律师了，他们说只要登广告期间没发现有合格的就
不会影响我的PERM申请。律师答复之前，我问老板要是真的有影响的话该怎么办，他说
他会跟HR说这是两个根本不同的职位。
怎么不同律师说法还不一样呀。
