We will need to determine the strategy for filing the petition. We could
request a "change of status" in which case, if your H-1B petition is
selected and approved, your status will change to H-1B on October 1, 2013.
Any international travel while the petition is pending at USCIS will abandon
the change of status request.
We could also file a "straight" H-1B petition. In this case, there is no
restriction on travel. If your H-1B petition is selected and approved, your
status would not change automatically on October 1, 2013, but you would
need to "activate" your H-1B status by traveling abroad and applying for H-
1B admission well in advance of your TN expiration date. Please let us know
if you have any family members in the US with you who would be impacted by
this as well.
