file another EB3 I-140 based on current PERM, or do an amendment for the
current EB2 I-140, or start another EB3 case from the very beginning.
Here is my attorney response. Share with you.
It is strange that this has happened. Normally, I would say stick with your
EB-2 approval and wait it out. Switching to EB-3 only to get your green card
sooner could backfire. That said, we can try and file for EB-3, but it's
risky. EB-3 priority dates never stay ahead of EB-2 priority dates for long.
It would require an amendment to your I-140 approval, which can't be premium
processed because the USCIS must request a copy of your PERM certification
from the DOL. Further, as an immigration attorney for 4 years, I've never
attempted this. Theoretically, it should be possible. If you truly want to
explore this option given the risk I've outlined, talk to your HR about
opening up a new I-140 case for you to file the I-140 amendment. |

递交amendment站eb3队伍放弃eb2呢？ |

下，失败了也不会怪他头上。出的各种各样option里我觉得只有重新file perm还能说
得过去。至少条款上没有明显漏洞

发帖数: 580 | 7 重新file PERM 法律上讲肯定万无一失，但是如果PD很接近eb3的排期的话，甚至按eb3
已经current的，我感觉直接file第二份140更划算吧，否则重新perm一通折腾下来和
eb2排队也差不多了
