EB3). My I-140 was approved in August 2010 and my priority date is March,
2010. I got laid off and had my visa changed to B2. I left the United States
to Australia before B2 expired and have been in Australia now for 4 months
.
I still want to go back to the U.S. Have some questions:
1) If I find a job in the U.S., can I apply for H1-B? If so, will I be
subject to quota?
2) If I can apply for H1-B and won’t be subject to quota, how do I apply
for H1-B?
3) EB3- China just retrogressed by a full 6-Consular Processing years,
If it moves fast forward again and my PD becomes current, can I apply for I-
485 through Consular Processing in Australia? Do I have to have a job in
order to apply for I-485?
