now I have EB3 I485 receipt which indicates PD earlier than EB2 PD in I140
approval notice. Can USCIS officers check my EB3 I-140 in his system based

notice. I think that all mails about I140 went to my company's attorney. | C********r

see if I am right
What you want is "PD porting" or "PD retention", aka, using your EB3 PD for
your NIW case.
I didn't do any of that before, but I think you can google that for many
cases.
I am guessing you can do it now, as the PD can be on your 140 (NIW). And if
you you have that early PD on your NIW, you can start asking to relink your
I-485 to NIW 140 (with early PD already)
You may be able to do that in one step too next month, I am just not so sure
about that.
But first, try to understand PD porting or retention

Thanks for your reply.
I have two approved I140s from EB3 and EB2 NIW, respectively, and have
submitted I-485 with pending status based on EB3.
You are right that I want to use my EB3 PD (April, 2012) for my EB2 NIW case
with PD: (Dec. 2012), because EB2 is current next month.
I just want to do something to tell USCIS officer that using EB3 PD can make
me greened.
Any further comments? Sorry I am poor on green card knowledge, so I really
need your advice. Maybe this process does not belong to transferring. |
