visa petition must be current in order to apply it to XXX’s adjustment of
status. So potentially, if EB-3 is not current when it comes time to link
the new I-140 to XXX’s AOS, XXX will have to wait for EB-3 to become
current to request that the new I-140 be linked to XXX’s AOS (which can be
a timely process in and of itself).
Given the cost and complexity of down-grading to EB-3, it is likely that it
will be more time and cost effective to remain in the EB-2 category and
extend XXX’s current Employment Authorization Document as necessary.
