I have EB2 140 and I am more than 180 days in 485 pending. I plan to leave
my current company in next 10 days (all is set and cannot be changed). My
current company agrees to help me out to downgrade to EB3 but I need to do
it myself. I asked on this board. According to Yoyo BZ, the new EB3 140 will
be valid even I do not work for my current employer anymore and if it fails
to get approved, it will not affect my EB2 140 and 485 process. I still
have a few more questions.
1. I plan to PP. But if it is not accepted the first time, can I redo PP
later? I will surely leave the current company already when pp gets rejected.
2. Still, if I get any RFE for new EB3 140, how should my company reply?
Again, I should have left already then.
