EB23版 - 急：perm 被 denied了，想做reconsideration 有遇到同样情况或者有靠谱律师推荐吗 |

发帖数: 1 | 1 四月份提交的perm 申请 上周收到DOL的信deny了，是因为职位要求里面的一个skill没
有在section K里面指明，具体如下，基本上是律师准备材料的失误，但是还是想去
argue一下，毕竟重新做的话，又要多等一年。
denial letter 里面提到的技能是一个还挺通用的绘图软件，我本科的成绩单里有这门
课可以证明我有这项技能，但是成绩单并没有提交过，而且申请是用的master的学位，
section K的工作描述里的一些内容也可以去说用的这个软件，不知道会不会可以争一
下。
大家有没有因为这个被拒的，之后做reconsideration 有成功的吗？或者有没有推荐做
perm比较有经验的律师，谢谢啦！
"The foreign worker's qualifications as listed on the application
demonstrate the foreign worker does not meet the requirements as described
in section H of the ETA Form 9089 (application). Specifically, per section H
.14, the employer requires skill or knowledge in:
Section K of the application instructs the employer to list all jobs the
alien (foreign worker) has held as well as list any other experience that
qualifies the foreign worker for the job opportunity for which the employer
is seeking certification. Further, the Office of Foreign Labor Certification
(OFLC) posted an FAQ dated July 28,2014, stating:
"ETA must assess whether the foreign worker possesses all the qualifications
for the employer's job opportunity. When the employer lists specific skills
and other requirements for the job opportunity in Section H, Question 14,
the employer must also demonstrate on the ETA Form 9089 that the foreign
worker possesses those skills and requirements. In order to do so, the
employer should list separately in Section K all the foreign worker's
qualifications, such as certificates, licenses, professional coursework, or
other credentials that meet the requirements to perform the job opportunity
listed in Section H, if those qualifications have not already been
explicitly identified under information about the jobs held in the past
three years. If not listed elsewhere, the list of certificates, licenses,
professional coursework, or other credentials held by the foreign worker and
in order to the should be entered after all jobs held in the past three
years are listed, under Question 9, "Job Details (duties performed, use of
tools, machines, equipment, etc.) ..."
The application was filed on after the FAQ posting date. Thus, the employer
must demonstrate that the foreign worker possesses the employer's
requirements for the job opportunity. Nevertheless, section K does not
specify that the foreign worker has knowledge or skill in any of the
