Your new job is based on the H1-B.
One company can sponsor your green card before you even work for them. In
your case, as long as you have not used your EAD and still on H-1B. Your new
employer has nothing to do with your 485 application.
If you used your EAD in your new employer, then you have to porting, because
your work is based on EAD and you changed your employer. Your are the
beneficiary of AC21. |

When your I-485 application has been pending at least 180 days and you move
to a same or similar role, you may use AC21 to transfer your green card
process from a sponsoring employer to a new sponsoring employer. The USCIS
prefers proactive notification that you have changed to a new employer, but
there is not a set day by which the notification must be filed. Once we
receive the requested documents from you, we will strategize regarding when
to best file your AC21 notification and let you know if we recommend waiting
to file your notification. |
