跳槽需要relocation,最近貌似属于搬家旺季,搬家公司需要提前4-6周预约,完了运
东西还需要2-18天,所以从现在的公司辞职到开始在新公司上班之间会有一段时间的
gap。想问一下这段时间的gap对我的H1B和140申请会有影响么?谢谢! |

请新公司在你离开职位前的一个礼拜递交H1b Transfer,等你真正辞职的时候uscis应
该已经发了receipt了。。。那你也可以走的安心了。。。 |

我的建议仍然是辞职前先让新雇主递交transfer,新公司确认收到了移民局的transfer
receipt你再辞职。 |

you are not supposed to have any gaps in employment. So you have to at least
be on payroll from A or from B. If an RFE is issued, and they ask for proof
of maintaining H-1B status, you are going to need to show them paycheck
stubs. So your start date with the new company needs to be as soon as you
finish with the current company. So either get A to keep you on payroll
until you can start with B, or get B to start you on payroll early as soon
as you leave A.

我的H1b收到过RFE关于proof of maintaining status。移民局需要我提供的证据是
Receipt当日我在美国的合法身份证据。。。所以只要旧雇主的last paycheck stub
date cover到移民局H1b transfer receipt date,你就是安全的。
根据移民局规定,只要你有正在移民局pending或者appeal中的case,你在美国的身份
就默认是暂时合法的。你要是还不放心就去USCIS官网上查一下吧。
Worst Case Scenario,你要是仍然还不放心,只能厚着脸皮跟新雇主讲,第一张pay
stub的起始日期开在你离开旧雇主的那天呗~~~

不过实际中貌似没有见过因为这个被卡绿卡的。有一两个月gap的人大把
