【背景】H4. EAD，AP卡已经到手两年。一直用AP卡出入境。AP卡8月底过期，5月提交
了renew，然后回国。回来发现AP renew被拒（之前不知道renew期间不能回国）。后来
重新提交了AP renew申请但是现在还没有到手。
【问题】现在9月有急事需要回国。到时候AP renew不知道能不能办下来。不能办下来
的话，能在国内申请H4 visa入境吗？有什么办法能催催AP renew吗？ |

发帖数: 489 | 3 别提了。这次renew一波三折。第一次说表格旧打回来（查了查是有了新的表格），第
二次说没交费打回来（但是renew是不收费的呀！），第三次说pending期间出境打回来
的。
我确定是出境被拒的。因为里面说"The instruction of I-131 indicate that if you
depart the US before the Advance Parole Document is issued, your
application will be considered abandoned". 后面又说"A review of USCIS
records indicates that you departed from the U.S. on May XX 2017, while form
I-131 was pending. Therefore, the form I-131 is considered abandoned and it
must be denied".
7月底刚刚重新递交了renew申请。这次回国比较重要。如果实在不行可以再forfiet一
下AP卡。。不过不知道用H4回来？当然最好的情况是AP一个月之内能寄到家里。。

碰上业务不熟的IO了，你可以appeal
ap pending期间离境再用H-4入境不会导致I-485或者ap申请被拒
当然只是根据规定，再碰上业务差的IO也只能算你倒霉，可以appeal

这次碰到两次不靠谱的IO了。一次说我们renew没交费，我附上了instruction里面的文
件说不用交费。第二次说AP renew期间不能出境。
我看了一下这个pdf。里面说的case，(b) Yes, we confirm that that abandonment
of a pending advance parole application does not occur if the foreign
national is otherwise authorized to depart and return because the foreign
national has an 1-485 pending and is readmitted as an H-1, H-4, L-1, L-2, K-
3, K-4, V-1, V-2, or V-3.29
这意思是说我们回来应该以H4重新入境吗？我们是用AP入境的有问题吗？
我们上次没有appeal，只是重新递交了申请。现在更大的问题是这次回国期间能不能用
H4申请visa入境？如果没有的话就没法回国了因为回不来。

那里面说如果你有valid AP且在ap过期前回来不算abandon 新的AP申请
关于你的更大问题，你说的(b)还不能回答？

最新消息好像说USCIS会改正错误了。

your local USCIS field office to request expedited processing. Search "
Emergency Travel" on USCIS website and follow the instruction.
2. Whether you can apply H4 visa depends on whether your spouse has a valid
H1B status. Because you said the H1B holder used EAD and AP in the past, it
is possible he/she is not in H1B status any more and then you cannot use H4
visa to re-enter the US.
