公司前段时间被收购了，2019年初要撤销以前的所有公司文件，归化到母公司名下。公
司的税号，名称什么的就都要变，员工也得和母公司重新签合同以及相关文件。
1. 想问下这种情况到时候是不是得transfer H1B, 然后从PERM开始再I140全部重新弄
一遍？
2. 如果这趟让公司办EB3单飞，还能relink之前EB2的PD么？
3.是不是跟现在去其他地方另外找份工作要走的流程一样呢？

很悲剧。我也类似的情况。正在和HR商量。可不可以不要动。 |

perm。不知道在perm阶段是不是也可以SII。 |

现在也在面试其他公司，考虑跳槽，看来怎样都免不了再走一趟了。

发帖数: 281 | 8 你可以试试和HR、律师谈楼上的那个successor in interest不用重走perm是最好的了。
我的是整个小team要从一个子公司，划到另一个子公司。律师说这种要重来。
刚刚得到HR的信，说可以不挪我。还算幸运。

本身是大公司，最近我们部门被另一家大公司收购，工作地点不变，对方也是F家律师
，来作宣讲的时候明确表示不需要重新Perm。 |

Status has not been filed at the time of the merger or acquisition, then the
new entity must file an I-140 petition with USCIS and prove that it is a
successor-in-interest employer.
Where an I-485 Adjustment of Status application is pending at the time of
the merger or acquisition, the portability provisions of the American
Competitiveness in the 21st Century Act (AC21) permit the employee to
transition to a new employer if the I-485 application has been pending for
over 180 days and the employee’s job function and duties are the same or
similar to those with the original employer. If the I-485 has been pending
for less than 180 days at the time of the merger or acquisition, then the
new entity should file an amended I-140 petition.
