坐标东部地区。EB2申请，PERM刚批准，有一份老东家的approved I-140（old PD=2015
/2），所以8月排期当前。我想请公司律师双飞同时port old PD to new 140.但律师回
答说因为需要port，所以双飞时mailroom可能会拒收485申请，因此建议我先140pp，两
周通过后再file 485。
想问下大家意见。分开file比双飞，拿到RD的时间应该会更晚，但似乎也就晚两周所以
问题不大？
律师回复如下（删掉了名字信息）
I wanted to provide XYZ thoughts on concurrent filing. Since we would be
asking for the retention of your priority date on your earlier I-140, XYZ
feels that it would be best to file the I-140 first (premium processing) and
ask for the retention of the priority date, then once we have that priority
date on an approved I-140 file your I-485 application.
We can still work it out so we can file under the August visa bulletin. If
we file concurrently we may run into a problem with mailroom rejecting the
485 application because of the priority date. |
