发帖数: 1 | 1 去年八月份交的NIW I140，TSC，自己DIY的，最近收到RFE，Challenge了所有三个
prongs。特来向大家请教。
我去年申请的时候的基本情况是：1）美国博士学位（博士所在的系在美国排名第一）
，现在一所综合排名80，专业排名15左右的大学做助理教授，工程方向；2）7篇
journal，1篇会议；3）citation 78；4）审稿13；5）几项乱七八糟的奖，例如最佳学
生论文，最佳博士论文，有一篇文章被业内杂志highlight；6）5封很强的推荐信，其
中3封独立的（其中一封来自于一美国工程院院士）7)一项NSF funding (Co-PI)。
收到的RFE如下：
The beneficiary intends to work as a Tenure-Track Assistant Professor.
In order to establish eligibility, the petitioner must establish that:
1)The beneficiary qualifies for the requested classification; and
2)An exemption from the requirement of a job offer, and thus of a labor
certification, is the national interest of the United States.
USCIS has designated Matter of Dhanasar, 26&..........Under Dhanasar, USCIS
may grant a national interest waiver as a matter of discretion if the
petitioner demonstrates by a preponderance of the evidence that:
1) The beneficiary's proposed endeavor has both substantial merit and
national importance;
2) The beneficiary is well-positioned to advance the proposed endeavor;
and
3) On balance, it would be beneficial to the United States to waive the
requirements of a job offer and thus of a labor certification.
If these three elements are satisfied, USCIS may approve the national
interest waiver as a matter of discretion.
The evidence does not establish that
1) The beneficiary's proposed endeavor has both substantial merit and
national importance;
2) The beneficiary is well-positioned to advance the proposed endeavor;
and
3) On balance, it would be beneficial to the United States to waive the
requirements of a job offer and thus of a labor certification.
Therefore, USCIS requires additional evidence.
National Importance:
.....The beneficiary's proposed endeavor has substantial merit; however, the
record fails to support the beneficiary's statement that his proposed
endeavor is of national importance.....
Well-positioned to advance the proposed endeavor:
The beneficiary has provided documentation of his academic credentials,
copies of his academic research and letter of recommendation. The submitted
evidence demonstrates you have gained experience in your endeavor. The
submitted evidence, however, is insufficient because academic and
experiential qualification is only one factor to be considered in
determining whether the beneficiary is well-positioned to advance his/her
proposed endeavor. Others include whether he/she has shown a record of
success in his/her previous work, his/her progress towards achieving his/her
proposed endeavor, and the levels of interest in his/her endeavor from
relevant individuals.
Therefore, please submit evidence to establish that the petitioner is well-
positioned to advance the proposed endeavor. Evidence which best establishes
that the beneficiary is well-positioned to advance the proposed endeavor
will document the beneficiary's qualification (skills, experience, and track
record), support (financial and otherwise) and commitment (plans and
progress) to derive the endeavor forward, and will support projections of
future work in the proposed endeavor. ......
On balance, it would be beneficial to the United States to waive the
requirements of a job offer and thus of a labor certification:
....The record fails to demonstrate that it would be impractical either for
the beneficiary to secure a job offer or for the petitioner to obtain a
labor certification; that even assuming that other qualified U.S. workers
are available, the United States would still benefit from the beneficiary's
contributions; that the national interest in the beneficiary's contributions
is sufficiently urgent to warrant forgoing the labor certification process;
and that on balance, it would be beneficial to the United States to waive
the requirements of a job offer and thus of a labor certification.

我也是这个方向的。
我也是去年8月份申请的NIW，已经通过了。
我的背景，当时快毕业了，文章四篇，全部非一作，一篇IF > 35, 引用150， 审稿20。
当时我律师主要强调了我这个project能给美国带来什么，而不是具体发了多少篇文章
之类的。还有就是强调了一下我美国政府相关的那些funding, 以及一个给空间站实验
做的样品。从而体现我的学术生涯受到美国官方资助，留在美国符合美国国家利益。 | x********8
