1/31送老大去学钢琴，本来都已经迟到了， 一不留神错过了左转的出口，毛焦火辣中
突然看到前面有个口子， 马上打起左转灯， 一到就转了。哪知刚转过来就见后面警灯
闪闪, 心里暗叫一声"倒霉", 把车靠边等着. 然后警察就上来说, do you know left
turn is not allowed at that intersection? 我说没看到有No Left Turn的sign啊.
他一边写ticket一边说, 您到法庭上跟法官说去吧: Improper left turn/U-turn ...
这下就更迟到了...回家后越想越没对, 这个路口我每周都要进出好多次(主要是右拐)
, 怎么就从来没记得有不让左转的标记呢? 改天又从西向东走了一遭, 确实没有sign.
然后到附近类似的有中间隔离带的6-lane路上跑了一下, 哈哈! 凡是不让左转或U-turn
的地方都有sign! 随后拍下几张相片不表.
转眼到了ticket上的出庭时间. 冒着损失200刀一小时的危险到了city court, 好几十
号人已经在里面了, 还不时有婴儿的哭叫声. 好不容易轮到了我--已经损失300刀了--
法官问你选择啥: pay fine, go to driving school, ask for hearing. 我说半年前
已经上过school了, 现在不行了吧? 我要ask for hearing. 于是就schedule 到9am, 3
/20. 又要损失200刀, 加起来已经double fine了. 不过为了争这口气, 还是要上.
于是提前5分钟到了court, 比上次的房间小, 就两排位置. 随后警察也到了, 笑着打了
个招呼. 法官大人迟到了15分钟才来. 原来今天就我一个case. 法官先介绍了一下这个
程序, 说这个hearing呢是police offer's responsibility to provide evidence to
justify the ticket, 让我不要紧张. 然后让警察先说. "Your Honor, I'd like to
ask for change the citation code first...", 法官和我都一楞: why? "Because I
think Code 5 is better fit the violation described on the ticket..." 法官说
, No, 现在你不能改了. 我一听这话, 看来今天有戏啊...
然后警察就在白板上画了这个intersection的图, 描述了一下当时的情形, 基本上都对
的. 然后说, " I know there's no sign prohibiting a left turn or U-turn from
West to East, but the defendant made a dangerous move as he didn't sign his
signal, and slowed down rapidly to make this move during peak traffic time,
which cased several vehicles behind him to brake suddenly, which was a very
dangerous move. Also after he made the turn, he turned all the way to the
far right lane, or the curb lane, which was dangerous for incoming traffic..
." 我一听到这里, 暗叫: 糟了, 这家伙肯定是发现了这个没有No Turn sign的漏洞,
然后从另一个角度来抓漏眼了...
接下来就轮到我了. 来不及想那么多, 我还是先把准备好的sign的事情说了一遍, 把相
片都show了, 然后说当时我是因为miss了前面的turn, 所以一直呆在最左边的lane, 打
着左转灯, 随时准备找到口子就转的, 所以速度并不快. 但法官说他是个experienced
police officer, and is competent to make correct judgement...然后他停下来研
究ticket...
接下来是静静的一分钟, 听法官这么一说我都快失望了...忽然, "Now I see why
Officer B wanted to change the code...If it was Code 5, I'd say the ticket
is valid and I'd ask Mr. Bison to pay the judgement. Code 5 says: A person
shall not so turn any vehicle without giving an appropriate signal in the
manner provided by this article in the event any other traffic may be
affected by the movement.
B. A signal of intention to turn right or left when required shall be given
continuously during not less than the last one hundred feet traveled by the
vehicle before turning.
C. A person shall not stop or suddenly decrease the speed of a vehicle
without first giving an appropriate signal in the manner provided by this
article to the driver of any vehicle immediately to the rear when there is
opportunity to give the signal.
However, since it's Code 2 on the ticket, it says: Left turns. The driver
of a vehicle intending to turn left shall approach the turn in the extreme
left-hand lane lawfully available to traffic moving in the direction of
travel of the vehicle. If practicable the driver shall make the left turn
from the left of the center of the intersection and shall make the turn to
the left lane immediately available for the driver's direction of traffic.
The Code 2 only regulates left turns, and does not say anything about U-
turns, and we know U-turns take bigger space to finish. So Mr. Bison, you
will not pay anything. You can go now. | p****u
