The employer did not withhold FICA taxes from my pay in my OPT, and I have
been considered as a resident alien for federal tax purpose in that time.
The company I am working for uses the payroll service provided by PAYCHEX,
Do I have to pay the FICA taxes through PAYCHEX and get a new W-2 for 2010,
or just file form 1040 and wait for IRS response? | k**y
发帖数: 1379 | 4 I am not tax professional, but from what I understand, you don't have to
worry about FICA. What you file every year is income tax return. If you pay
too much of FICA, you can get it back from income tax return. Or you can pay
nanny tax through your income tax return. But if you did not pay enough,
most likely your company did not pay enough either, IRS will request
information from your company.I don't think you can pay FICA from your
income tax return. If you think you should pay FICA, you have to let your
company know and your company will need to work with Paychex to amend 941
return, and amend your W-2. Your company has to pay late payment penalty and
etc.
